EXEMPTION FROM PARAGRAPH 421.71(3)(b) and 421.79(3)(b) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt members and former members of the Canadian Forces who are or were Qualified Flying Instructors (QFIs) from paragraphs 421.71(3)(b) and 421.79(3)(b) of the Canadian Aviation Regulations (CARs) Standards, made pursuant to section 401.06 of the CARs, subject to the following conditions.

Paragraph 421.71(3)(b) Class 2 - Aeroplane – Requirements - states that an applicant shall have recommended no fewer than 10 applicants for the recreational, private and/or commercial flight test, of which a maximum of 3 may be for the recreational flight test.

Paragraph 421.79(3)(b) Class 2 - Helicopter – Requirements – states that an applicant shall have recommended no fewer than 10 applicants for the private and/or commercial flight test.

PURPOSE

The purpose of this exemption is allow applicants for a Class 2 flight instructor rating – aeroplane or helicopter – who are or were Qualified Flying Instructors in the Canadian Forces, to obtain the Class 2 flight instructor rating without having recommended candidates for civil flight tests.

APPLICATION

This exemption applies to applicants for a Class 2 flight instructor rating – aeroplane or helicopter – who are or were Qualified Flying Instructors in the Canadian Forces.

CONDITIONS

This exemption is subject to the following conditions:

  1. The applicant shall hold a valid Class 3 flight instructor rating in the appropriate category.
  2. The applicant shall provide proof of having conducted, in the category applicable to the flight instructor rating being sought, a minimum of 500 hours of flight instructor experience, including a minimum of 400 hours dual flight instruction for the issue of a civil pilot licence or to military wings standards.  A credit of 100 hours of flight instructor experience may be given for flight instruction conducted within the Primary Flying Training Course.
  3. The applicant shall be a member or former member of the Canadian Forces and shall be or have been a Qualified Flying Instructor.
  4. The applicant shall have been recommended for the Class 2 flight instructor rating flight test by a holder of a Class 1 flight instructor rating.
  5. The holder of the Class 1 flight instructor rating who has recommended the applicant shall certify that the applicant has completed a course of instruction that meets the learning objectives set out in Appendix A.
  6. The flight test for the Class 2 flight instructor rating shall be conducted by a qualified Transport Canada inspector.

Note:  In order to advance to a Class 1 flight instructor rating, all requirements, including flight test recommendations, shall be met.

VALIDITY

This exemption is in effect until the earliest of the following:

  1. March 31, 2010 at 23:59 EST;
  2. The date on which any of the conditions set out in this exemption are breached; or 
  3. The date on which this exemption is cancelled, in writing, by the Minister, where he is of the opinion it is no longer in the public interest or is likely to affect aviation safety.
