Pursuant to section 602.160 of the Canadian Aviation Regulations (CARs), I hereby exempt, WestCan International Airlines Ltd., Box 9848, Edmonton International Airport, Edmonton, AB T5J 2T2, from the requirements set out in paragraphs 602.152(a) of the CARs subject to the following conditions.
Subsection 602.152(a) states that after April 1, 2002, no person shall operate an aeroplane to or from an aerodrome in Canada unless the aeroplane is a Chapter 3 aeroplane.
Purpose
The purpose of this exemption is to allow WestCan International Airlines Ltd. to operate one (1) gravel equipped aeroplane in a Chapter 2 configuration for northern operations in accordance with section 602.161 of the CARs.
Application
The exemption applies to one (1) gravel-equipped aeroplane operated by WestCan International Airlines Ltd. under the Air Operator Certificate Number 10952 for its northern operations in a Chapter 2 configuration. Specifically, the aircraft to which this exemption applies is:
- Boeing 727-22C, serial number 19195 registration C-GHWC
Conditions
This exemption is subject to the following conditions:
- The aircraft specified in this exemption shall serve the northern communities identified at Appendix B within the designated Northern Area, as defined at Appendix A;
- WestCan International Airlines Ltd. shall not operate to or from aerodromes south of the designated area except in a configuration that is Chapter 3 compliant;
- The aircraft shall be equipped for operations on gravel runways; and
- A copy of this exemption shall be carried in the journey log of the aircraft subject to this exemption.
Validity
This exemption is valid until the earliest of:
- 24:00 MDT on 15 December 2008;
- The date on which an amendment to the relevant sections of the CARs comes into effect;
- The date on which any condition specified in the exemption is not complied with; or
- The date on which the exemption is canceled in writing by the Minister, where he is of the opinion that it is no longer in the public interest or it is likely to affect aviation safety.

APPENDIX “A”
“Designated area,” means that part of Canada north of a line described as follows:
- Commencing on the point of intersection of the Atlantic coast of Canada with the 50th parallel,
- Thence west along the 50th parallel to the point of intersection of that parallel with the border of Ontario and Manitoba,
- Thence northwesterly along a straight line drawn from the intersection of the 50th parallel with the border of Ontario and Manitoba to the intersection of the 53rd parallel with the border of Manitoba and Saskatchewan,
- Thence northwesterly along a straight line drawn from the intersection of the 53rd parallel with the border of Manitoba and Saskatchewan to the intersection of the 55th parallel with the border of Saskatchewan and Alberta, and
- Thence west along the 55th parallel to the Pacific coast of Canada.
