EXEMPTION FROM PARAGRAPH 703.24(c) AND SUBPARAGRAPH 703.88(1)(c)(ii) OF THE CANADIAN AVIATION REGULATIONS AND SECTION 723.24 OF THE COMMERCIAL AIR SERVICE STANDARDS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and not likely to affect aviation safety, I hereby exempt Canadian air operators and pilots-in-command of single-engined Bell 204 or Bell 205 helicopters from the requirements of section 723.24 of the Commercial Air Service Standards (CASS) made pursuant to paragraph 703.24(c) of the Canadian Aviation Regulations (CARs), and subparagraph 703.88(1)(c)(ii) of the CARs, subject to the following conditions. 

Section 723.24 of the CASS requires that an air operator and pilot-in-command operating single-engine helicopters where more than nine (9) passengers are carried on boardmust ensure that the pilot has successfully completed the required single-engine Pilot Proficiency Check (PPC) on one of the single-engine helicopter types operated by the air operator carrying more than nine (9) passengers.

Subparagraph 703.88(1)(c)(ii) of the CARs requires the pilot-in-command of a single-engined helicopter to have successfully completed a PPC on one of the types of single-engined helicopters operated by the air operator.

PURPOSE

The purpose of this exemption is to allow Canadian air operators and pilots-in-command operating Bell 204 or Bell 205 helicopters to be deemed to have met the PPC requirements for these helicopter types, as set out in section 723.24 of the CASS, and subparagraph 703.88(1)(c)(ii) of the CARs, by successfully completing a PPC on either the Bell 212 or Bell 412.

APPLICATION

This exemption applies to Canadian air operators and pilots-in-command operating the following types of single-engine helicopters: Bell 204 or Bell 205.  The exemption does not apply to Canadian air operators and pilots-in-command operating a single-engine helicopter type other than Bell 204 or 205.

CONDITIONS

 This exemption is subject to the following conditions:

  1. The PPC on the Bell 212 or Bell 412 helicopters shall not be used to fulfill the requirements of subparagraph 703.88(1)(c)(ii) of the CARs unless the Bell 204 or Bell 205 are the only single-engine helicopter types to be operated;
  2. The pilot-in-command, during the pilot proficiency check on either a Bell 212 or Bell 412 helicopter shall have successfully completed autorotative approaches to terminate at a pre-determined area and at least one approach requiring a turn during autorotative descent through at least 180 degrees.

VALIDITY

 This exemption is in effect until the earliest of:

  1. the date on which any of the conditions set out in this exemption is breached;
  2. the date on which an amendment modifying the subject-matter of paragraph 703.24(c) and subparagraph 703.88(1)(c)(ii) of the Canadian Aviation Regulations addressed specifically in this exemption, or related standards comes into effect; or
  3. the date on which this exemption is canceled in writing by the Minister where he is of the opinion it is no longer in the public interest or is likely to affect aviation safety.
