Exemption From paragraph 704.108 (d) of the Canadian Aviation Regulations

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after having taken into account that the exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt TRIUMPH AIRWAYS LTD, 1190 Keith Ross Court, Oshawa, Ontario, L1H 7K4, from the requirements of paragraph 704.108 (d) of the Canadian Aviation Regulations, subject to the conditions set out below.

The subparagraph states that no air operator shall permit a person to act and no person shall act as a flight crew member of an aircraft unless the person has fulfilled the requirements of the air operators ground training program and, except where undergoing line indoctrination training, the air operators flight training program.

Purpose

The purpose of this exemption is to allow Brian A. Buchartz, license number AA344964 to act as training captain on Basler DC3T aircraft, operated by TRIUMPH AIRWAYS LTD for the purpose of Line Indoctrination Training

Application

This exemption applies to TRIUMPH AIRWAYS LTD., 1190 Keith Ross Court, Oshawa, Ontario, Air Operator Certificate number 9840, while operating Douglas DC3 C-GEM.

Conditions

This exemption is subject to the following conditions:

1. Brian A. Buchartz must have completed all training requirements in accordance with TRIUMPH AIRWAYS LTD. approved training program, exclusive of line indoctrination training

Validity

This exemption is in effect until the earliest of:

  1. the date on which any of the foregoing conditions is not complied with;
  2. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion t it is no longer in the public interest or that it is likely to affect aviation safety or for cause; or
  3. 23:59 EST on August 25, 2005.
