Exemption From Paragraph 704.108(1)(c) of the Canadian Aviation Regulations (CARs) and paragraph 724.108(1)(e) and Section 724.108, Schedule I, Subparagraph (2)(d)(iv) of the Commercial Air Service Standards (CASS)

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Canadian air operators conducting commuter operations and the pilots employed by those operators from the requirements of paragraph 724.108(1)(e) and section 724.108, schedule I, subparagraph (2)(d)(iv) of the Commercial Air Service Standards (CASS) made pursuant to paragraph 704.108(1)(c) of the Canadian Aviation Regulations (CARs), subject to the following conditions.

Paragraph 704.108(1)(c) of the CARs requires that Canadian air operators conducting commuter operations not permit a person to act as a flight crew member unless the person has successfully completed a pilot proficiency check (PPC) in accordance with the CASS.

Paragraph 724.108(1)(e) of the CASS requires that, for the purpose of completing the pilot proficiency check, training and checking procedures not approved for the synthetic flight training device shall be completed in the aeroplane.

Section 724.108, schedule I, subparagraph (2)(d)(iv) of the CASS requires, where the flight crew is authorized to conduct circling approaches in accordance with the company operations manual, one approach and manoeuvre to land using a scene approved for circling and demonstrated during an initial qualification check and annually thereafter.

Purpose and Application

The purpose of this exemption is to permit pilots employed by Canadian air operators conducting commuter operations under subpart 4 of part VII of the CARs to complete the PPC in a level A or B full flight simulator without demonstrating the circling procedure required by section 724.108, schedule I, subparagraph (2)(d)(iv), or without completing the PPC on the aeroplane as required by paragraph 724.108(1)(e) of the CASS where the circling scene has not been approved for the synthetic flight training device.

This exemption applies to Canadian air operators conducting commuter operations and the pilots employed by those operators where the PPC is conducted in a level A or B full flight simulator that does not have an approved circling scene.

Conditions

This exemption is subject to the following conditions:

  1. each pilot shall have successfully completed the PPC in the approved full flight simulator, except for the circling procedure required by subpart 724.108, schedule I, subparagraph (2)(d)(iv) of the CASS;

  2. the pilot shall successfully demonstrate in the aircraft, for the air operator company check pilot, aeroplane type chief pilot, or aeroplane type training pilot, a circling procedure to the minima published in the Canada Air Pilot;

  3. each pilot shall demonstrate the circling procedure as specified in condition 2 during his or her initial line indoctrination and at least once every two years thereafter;

  4. the air operator company check pilot, aeroplane type chief pilot, or aeroplane type training pilot, for whom a pilot successfully demonstrates the circling procedure, shall record the successful completion of the circling procedure as specified in conditions 2 and 3 in the pilot’s training record.

Validity

This exemption is in effect until the earliest of the following:

  1. 23:59 EST on June 30, 2004;
     
  2. the date on which an amendment to the appropriate provisions of the Canadian Aviation Regulations and related standards comes into effect;
     
  3. the date on which any of the conditions set out in this exemption is breached; or
     
  4. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or that it is likely to affect aviation safety.
