Exemption from Paragraph 705.106 (1) d) and Subsection 705.124 (1) of the Canadian Aviation Regulations

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Aviation Starlink Inc., 9025 Ryan Avenue, Dorval, Quebec H9P 1A2, pursuant to part VII, subpart 5 of the Canadian Aviation Regulations (CARs), from the requirements set out in paragraph 705.106 (1) d) and subsection 705.124 (1) of the CARs, subject to the following conditions:

Paragraph 705.106 (1) d) stipulates that flight crew members must have successfully completed or must be undergoing a line check or line indoctrination training, the validity period of which has not expired, for that type of aircraft, in accordance with the Commercial Air Service Standards.

Subsection 705.124 (1), pursuant to the conditions set out in division 725.124 (4) c) (B), stipulates that training pilots must be qualified for line flying on the type of aeroplane; and, pursuant to paragraph 725.124 (4) e), LOFT facilitators must: ii) have at least two years of line flying with the air operator for which the duties will be performed; (iii) have previous experience in training of air operator crews; (vi) maintain line familiarity of at least six flight sectors within the preceding twelve months on the aeroplane on which the instruction will be given.

PURPOSE

This exemption allows Aviation Starlink Inc. to conduct line indoctrination training of members of the flight crew on Embraer 120 aircraft, using Stephen Douglas Wade as a training pilot and LOFT facilitator based on his experience with this type of aircraft, even though he has not completed a line check or line indoctrination training for this type of aircraft.

APPLICATION

This exemption applies only to Stephen Douglas Wade, licence number AA130246, acting as a training pilot.

CONDITIONS

This exemption is subject to the following conditions:

  1. A copy of this exemption shall form part of the candidate’s training file;
  2. All training related to the approved EMB120 training plan must be completed and documented in the candidate’s file;
  3. A line check, under the supervision of Transport Canada, must be completed by April 1, 2005.

VALIDITY

This exemption is in effect until the earliest of the following:

  1. 11:59 p.m. EST, April 1, 2005;
  2. the date on which any of the conditions set out in this exemption is breached;
  3. the date on which this exemption is cancelled, in writing, by the Minister, where he is of the opinion it is no longer in the public interest or is likely to affect aviation safety.
