EXEMPTION FROM PARAGRAPH 7.8.5(a) AND PART EIGHT OF THE FLIGHT ATTENDANT TRAINING STANDARD AND PARAGRAPH 705.124(1)(b) AND CLAUSES 705.124(2)(b)(iv)(C) AND (E) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Nolinor Aviation, 10105 Avenue Ryan, Dorval, Quebec, H9P 1A2, from the requirements of clauses 705.124(2)(b)(iv)(C) and (E) of the Canadian Aviation Regulations (CARs), and the elements of paragraph 7.8.5(a) (initial training) and part eight (initial training) of the Flight Attendant Training Standard (TP 12296) drafted in accordance with paragraph 705.124(1)(b) of the CARs, subject to the conditions set out below.

Clauses 705.124(2)(b)(iv)(C) and (E) of the CARs stipulate that an air operator’s training program shall include, in respect of flight attendants, initial and annual training, including emergency procedures training and first aid training.

Paragraph 7.8.5(a) (initial training) of the Flight Attendant Training Standard (TP 12296) drafted in accordance with paragraph 705.124(1)(b) of the CARs, stipulates that each trainee shall demonstrate the effectiveness of a fire extinguisher correctly applied to an actual fire while wearing a P.B.E.

Part eight (initial training) of the Flight Attendant Training Standard (TP 12296) drafted in accordance with paragraph 705.124(1)(b) of the CARs, stipulates that the trainee will be able to define and demonstrate first aid in order to effectively handle an in-flight medical emergency situation.

PURPOSE      

The purpose of this exemption is to allow Nolinor Aviation, 10105, Avenue Ryan, Dorval, Quebec, H9P IA2 to:

  1. Change its approved flight attendant training program with respect to initial training for Ms. Heidi King, to exclude the elements of paragraph 7.8.5(a) (initial training) and part eight of the Flight Attendant Training Standard drafted in accordance with paragraph 705.124(1)(b) of the CARs dealing with, in paragraph 7.8.5(a) (initial training), the flight attendant’s live fire fighting drill, and in part eight, first aid, except for the parts relating to aircraft, for aircraft operated under subpart 705 of the CARs;

  2. Provide modified Nolinor Aviation initial training to Ms. Heidi King, since she received complete flight attendant initial training at Kelowna Flightcraft Air Charter Ltd., in May 2005.

APPLICATION

This exemption is applicable only to Nolinor Aviation, 10105, Avenue Ryan, Dorval, Quebec, H9P 1A2 (9232) in order to provide Ms. Heidi King modified flight attendant initial training.

CONDITIONS

This exemption is subject to the following conditions:

  1. Before Ms. Heidi King’s training begins at Nolinor Aviation, the company must obtain the following from Kelowna Flightcraft Charter LTD:

    1. written proof that the Kelowna Flightcraft Air Charter LTD initial training program is approved in accordance with the Flight Attendant Training Standard;
    2. written proof that Ms. Heidi King is a qualified flight attendant in accordance with CAR 705;
    3. written proof that Ms. Heidi King has taken first aid training, within the last three years;
    4. written proof that Ms. Heidi King has carried out live fire fighting drill exercises, within the last three years;

  2. Nolinor Aviation must retain a copy of the ministerial exemption as well as the documents listed in condition 1, above, in Ms. Heidi King’s training file;

  3. Nolinor Aviation must give Ms. Heidi King the initial training program before November 30, 2007.

VALIDITY

This exemption remains in effect until the earliest of the following:

  1. November 30, 2007, at 23:59 EDT [sic];
  2. the date on which any of the conditions set out in this exemption is breached;
  3. the date on which this exemption is cancelled in writing by the Minister, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
