EXEMPTION FROM PARAGRAPH 8.6.1.1 a) of THE AERODROME STANDARDS AND RECOMMENDED PRACTICES (TP 312, 4th Edition) made pursuant to subparagraphs 302.07(1)(a)(i) and (ii) of the CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Vancouver International Airport Authority, P.O. Box 23750, Airport Postal Outlet, Richmond, B.C., V7B 1Y7 operating under Subpart 2 of Part III of the Canadian Aviation Regulations (CARs) from the requirements set out in paragraph 8.6.1.1 (a) of The Aerodrome Standards and Recommended Practices (TP 312, 4th Edition)made pursuanttosubparagraphs 302.07(1)(a)(i) and (ii) of the CARs subject to the conditions of this exemption.  Subparagraphs 302.07(1)(a)(i) and (ii) of the CARs state that:

(1) The operator of an airport shall

(a) comply

(i) subject to subparagraph (ii), with the standards set out in the aerodrome standards and recommended practices publications, as they read on the date on which the airport certificate was issued, specifically subject to the following conditions,

(ii) in respect of any part or facility of the airport that has been replaced or improved, with the standards set out in the aerodrome standards and recommended practices publications, as they read on the date on which the part or facility was returned to service.
 
Paragraph 8.6.1.1 a) of TP 312, 4th Edition, stipulates that unless its function requires it to be there for air navigation purposes, no equipment or installation shall be on a runway strip, a runway end safety area, a taxiway strip or within the distances specified in Table 3-1, column 4, if it would endanger an aircraft.

PURPOSE

The purpose of this exemption is to allow Vancouver International Airport Authority to install 4 FOD radar towers on the runway strip of runways 08R-26L and 08L-26R. 

APPLICATION

This exemption applies to the Vancouver International Airport Authority, operating under Airport Operating Certificate Number 5151-P169 to install 4 FOD radar towers on the runway strip of runways 08R-26L and 08L-26R.   

CONDITIONS

This exemption is subject to the following conditions:

  1. No tower shall infringe any of the transitional surfaces having the following characteristics:
    1. The origin of the transitional surface shall be established no closer than 120m from the nearest runway centerline,
    2. The elevation of the point of origin shall be the elevation of the nearest point on the runway centerline,
    3. The first segment of the transitional slope shall extend upwards from the point of origin at a slope of 4:1 (25%) up to an elevation of 23m above the point of origin,
    4. The second segment shall commence at the upper end of the first segment at a slope of 7:1 (14.3%) up to an elevation of 45m above the airport reference point;
  2. The FOD radar towers shall be marked and lighted in accordance with the requirements of CAR 621.19;
  3. The FOD radar towers shall be depicted in the appropriate Aeronautical Information Publications;
  4. This exemption shall be recorded in Part II of the Airport Operations Manual; and
  5. A copy of this exemption shall be kept as an appendix in the Airport Operations Manual.

VALIDITY

This exemption is in effect until the earliest of the following:

  1. 23:59 EST, October 31, 2007;
  2. the date on which any condition set out in this exemption is breached;
  3. the date on which the exemption is no longer required due to related amendments in Part III of the Aerodrome Standards; or
  4. the date on which this exemption is cancelled in writing by the Minister, where he is of the opinion that it is no longer in the public interest or is likely to affect aviation safety.
