EXEMPTION FROM PARAGRAPHS 602.152(a) and (b) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt the ROMAVIA Romanian Aviation Company, 1, Dimitrie Cantemir Blvd. Bucharest, Romania from the requirements set out in  paragraphs 602.152(a) and (b) of the of the Canadian Aviation Regulations (CARs) subject to the following conditions.

Paragraph 602.152 (a) of the CARs states that, after April 1, 2002, no person shall operate an aeroplane to or from an aerodrome in Canada unless the aeroplane is a Chapter 3 aeroplane;

Paragraph (b) states that, after April 1, 2002, no person shall operate an aeroplane to or from an aerodrome in Canada unless the aeroplane has a MCTOW of less than 34 000 kg (74,956 pounds).

Purpose

The purpose of this exemption is to permit ROMAVIA Romanian Aviation Company to operate a Chapter 2, namely a B-707 aeroplane, registration YR-ABB, on a flight to Canada.  ROMAVIA Romanian Aviation Company will conduct landings and takeoffs between September 16 and September 23, 2004, at Montréal – Pierre Elliot Trudeau International Airport (CYUL)) and Ottawa Macdonald-Cartier International (CYOW) Airport. ROMAVIA Romanian Aviation Company is transporting the President of Romania on a state visit to Canada.

Application

The exemption applies to ROMAVIA Romanian Aviation Company when operating the following B-707 aeroplane, Registration YR-ABB, between September 16 and September 23, 2004.

Conditions

This exemption is subject to the following conditions:

  1. ROMAVIA Romanian Aviation Company shall operate all aircraft in support of the President of Romania, on a state visit to Canada;
  1. ROMAVIA Romanian Aviation Company shall conduct all aircraft landings and takeoffs only at Montréal – Pierre Elliott Trudeau International Airport (CYUL)) and Ottawa Macdonald-Cartier International Airport (CYOW);
  1. ROMAVIA Romanian Aviation Company shall operate the aircraft in accordance with the noise abatement procedures and restrictions in force at Montréal – Pierre Elliott Trudeau International Airport (CYUL)) and Ottawa Macdonald-Cartier International Airport (CYOW); and
  1. A copy of this exemption shall be carried on board the aeroplane at all times.

Validity

This exemption is valid until the earliest of:

  1. 23:59EDT, on October 25, 2004;
  2. The date on which any condition specified in the exemption is breached; or
  3. The date on which the exemption is cancelled in writing by the Minister, where he is of the opinion that it is no longer in the public interest or it is likely to affect aviation safety.
