EXEMPTION FROM PARAGRAPHS 723.22(1)(a) AND (b), AND 723.22(2)(f) OF THE COMMERCIAL AIR SERVICE STANDARDS MADE PURSUANT TO SUBSECTIONS 703.22(1) AND (2) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act and after taking into account that the exemption is both in the public interest and is not likely to adversely affect aviation safety, I hereby exempt Canadian air operators from the requirements of paragraphs 723.22(1)(a) and (b), and 723.22(2)(f) of the Commercial Air Service Standards (CASS) made pursuant to subsections 703.22(1) and (2) of the Canadian Aviation Regulations (CARs), subject to the conditions set out below.

Details of subsections 703.22(1) and (2) of the CARs and paragraphs 723.22(1)(a), (b), and 723.22(2)(f) of Standard 723 – Air Taxi – Aeroplanes are placed in Appendix A.

PURPOSE

Current paragraph 723.22(1)(a) permits only factory built single engine turbine powered aeroplanes for the transportation of passengers at night VFR or in IFR condition (called SEIFR). This has proven to be very restrictive and specific in its application. It precludes many other single engine aeroplanes with other potential engine combination from being given SEIFR authority. 

This exemption provides relief from this regulation by granting SEIFR authority to Canadian air operators to operate Cessna Caravan model 208 and 208B aeroplanes retrofitted with Honeywell TPE331-12JR turboprop engine in accordance with the Federal Aviation Administration (FAA) Supplemental Type Certificates (STC)  SA02291AK or SA 10841SC (see Appendix B and C respectively) and in full compliance with the conditions set out below.

APPLICATION

This exemption applies to Canadian air operators operating a Cessna Caravan 208 and/or 208B aeroplane that has been retrofitted with Honeywell TPE331-12JR turboprop engine in accordance with the FAA STC # SA02291AK or SA 10841SC.

CONDITIONS

This exemption is subject to the following conditions:

  1. The Air operator shall ensure that the Cessna Caravan 208 / 208B model is retrofitted with the Honeywell TPE331-12JR turbo-prop engine in accordance with the FAA issued STCs numbered SA02291AK or SA10841SC;
  2. The air operator shall ensure that the aircraft continues to be compliant with the aircraft Type Certificate Data Sheet (TCDS) and STC; maintains conformity with the applicable Continued Airworthiness Requirements; Airworthiness Directives, Service Bulletins and any other relevant airworthiness and maintenance safety requirement;
  3. The air operator shall comply with the conditions and limitations specified in the STCs (see Appendix B and Appendix C, as applicable);
  4. Except for paragraphs 723.22(1)(a), (b) and 723.22(2)(f) of the CASS, the air operator shall meet all the other requirements of section 723.22 of the CASS, as applicable;
  5. The air operator shall include in its training program the requirements of subsection 723.98(24) of the CASS and include all the other requirements of this section  as applicable, to ensure their flight crew members are trained and tested according to the prescribed standards, and are competent to operate Honeywell TPE331-12JR powered Cessna Caravan 208 / 208B models in SEIFR operations;
  6. The air operator's training program shall include syllabus covering Honeywell TPE331-12JR turbo-prop engine systems, normal/abnormal/emergency operations and its limitations, especially the Negative Torque Sensing (NTS) system fitted on this engine (in order to comply with TSB's safety recommendation);
  7. The air operator shall, in conformity with subsection 726.07(2) of the CASS (see Appendix A), include in its maintenance control manual the engine trend monitoring or equivalent procedure, as recommended by the engine manufacturer, to identify any deterioration in engine performance and reliability, and take immediate remedial action;
  8. The STC holder shall monitor the in-flight shutdown (IFSD) rate of the subject engine model and shall inform Commercial Flight Standards (AARTF), TCCA, of any rates higher than 0.01/1000  hours established over a 100,000 in service hours, determined by using a 12 month rolling window for the preceding one year, and any such spikes shall result in the termination of this exemption;
  9. The STC holder shall monitor all IFSD occurrence of the subject engine model and shall inform Commercial Flight Standards (AARTF), TCCA of any such event, and where the cause of which is not determined within 90 days (maximum) since the day of occurrence, shall result in the termination of this exemption; and
  10. This exemption shall terminate where there is a series of IFSD occurrences (more than two within one year) that are engine or systems related.

VALIDITY

The exemption is in effect until the earliest of the following:

  1. August 31, 2017 at 23:59 EDT;
  2. the date on which any of the conditions set out in this exemption is breached; or
  3. the date on which this exemption is cancelled, in writing, by the Minister, where he/she is of the opinion that it is no longer in the public interest or that it is likely to adversely affect aviation safety

703.22 Transport de passagers dans un aéronef monomoteur

  1. Sous réserve du paragraphe (2), il est interdit à l'exploitant aérien d'utiliser un aéronef monomoteur en vol IFR ou en vol VFR de nuit ayant des passagers à bord.
  2. L'exploitant aérien peut utiliser un aéronef monomoteur en vol IFR ou en vol VFR de nuit ayant des passagers à bord, si l'exploitant aérien respecte les conditions suivantes :

723.22 Transpoart de passagers dans un aéronef monomoteur

La norme à respecter pour le transport de passagers dans un aéronef monomoteur pour les vols IFR ou VFR de nuit est la suivante :

    1. Seuls les avions à moteur à turbine de série sont admissibles;
    2. la moyenne des temps de bon fonctionnement (MTBF) démontrée du moteur à turbine du type d'avion en cause doit être de 0,01/1 000 ou moins établie sur 100 000 heures de service; et
    3. la formation du pilote doit être conforme au paragraphe 723.98(24).
  2. Exigences relatives aux équipements de l'avion

    • f) une commande des gaz manuelle qui surpasse le régulateur de carburant et permet un fonctionnement continu illimité du moteur en cas de panne du régulateur de carburant;
