EXEMPTION FROM SECTION 403.03 OF THE CANADIAN AVIATION REGULATIONS AiVD PARAGRAPH 566.07(2) (b) OF THE AIRCRAFT MAINTENANCE ENGINEER LICENSING & TRAINING STANDARD

Pursuant to subsection 5.9 (2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and not expected to affect aviation safety, I hereby exempt Aircraft Maintenance Engineer (AME) licence applicants, who obtained their basic training through training systems other than a Transport Canada Approved Training Organization (ATO), approved in accordance with the current Aircraft Maintenance Engineer Licensing & Training Standard, Chapter 566, Division II (12/99), from the requirements of paragraph 566.07(2)(b) of the Aircraft Maintenance Engineer Licensing & Training Standard made pursuant to section 403.03 of the Canadian Aviation Regulations (CARs), subject to the conditions enumerated below.

Paragraph 566.07(2)(b) of the Aircraft Maintenance Engineer Licensing & Training Standard, currently requires AME licence applicants, who obtained their basic training through training systems other than a Transport Canada ATO, approved in accordance with the current Aircraft Maintenance Engineer Licensing & Training Standard, Chapter 566, Division II (12/99), to attempt their applicable technical subject matter examinations at an appropriately rated ATO.

PURPOSE:

The purpose of this exemption is to allow AME licence applicants, who obtained their basic training through training systems other than a Transport Canada ATO, approved in accordance with the current Aircraft  Maintenance Engineer Licensing & Training Standard, Chapter 566, Division II (12/99), to attempt their applicable technical subject matter examinations at a Transport Canada Center (TCC) instead of a Transport Canada ATO.

APPLICATION:

This exemption applies only to AME licence applicants who have not successfully obtained their basic training from a Transport Canada ATO, approved in accordance with the current Aircraft Maintenance Engineer Licensing & Training Standard, Chapter 566, Division II (12/99).

CONDITIONS:

This exemption is subject to the following conditions:

  1. AME licence applicants assessed in accordance with paragraph 566.07(2)(a), of the Aircraft Maintenance Engineer Licensing & Training Standard, shall make application to Transport Canada for authorization to attempt the applicable technical subject matter examinations using the Transport Canada AME Licence Application Supplement, form number 26-0638;
  2. The technical examinations shall be successfully completed within 12 months after the date on which Transport Canada approved the application;
  3. The passing grade for these examinations shall be 70%;
  4. AME licence applicants who fail an examination on the first attempt shall not be re-examined sooner than 30 days following the failure. AME licence applicants who fail a second or subsequent attempt shall not be re-examined sooner than six months following each failure;
  5. The AME licence applicants shall comply with the applicable provisions of all Canadian aviation documents issued pursuant to the Aeronautics Act; and
  6. The AME licence applicants shall comply with all other applicable Canadian Aviation Regulations, and in particular with all other requirements set out in section 403.03 of the Canadian Aviation Regulations for the issuance of an AME licence. -

VALIDITY:

This exemption is in effect until the earliest of the following:

  1. EST at midnight January 31, 2003;
  2. the date on which any condition set out in this exemption is breached;
  3. the date on which an amendment to the appropriate provisions of the Canadian Aviation Regulations comes into effect; or
  4. the date on which this exemption is canceled in writing by the Minister. where he is of the opinion it is no longer in the public interest, or is likely to affect aviation safety.
