EXEMPTION FROM SECTION 507.07 OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Bradley Air Services Ltd. (D.B.A. First Air), 3257 Carp Road, Carp, Ontario, K0A 1L0, from the requirements of Section 507.07 of the Canadian Aviation Regulations (CARS) subject to the conditions in this exemption.

Section 507.07 states that where an application for a flight authority is made in respect of an aircraft being imported, the applicant must comply with the importation requirements specified in Chapter 507 of the Airworthiness Manual.

Purpose

The purpose of this exemption is to permit Bradley Air Services Ltd. (D.B.A. First Air) to apply for a Certificate of Airworthiness, to allow issue of the flight authority and to temporarily operate their Aerospatiale - Aeritalia ATR 42-300 aircraft, Registration C-FTJB, Serial Number 119, without fully complying with the Standards of Airworthiness required by the CARS, as stated in the Transport Canada Type Certificate Number A-159- Issue 7, specifically without modification 1831, dealing with wiring protection in the hydraulic compartment.

Application

This exemption applies only to Bradley Air Services Ltd. (D.B.A. First Air) when operating Aerospatiale - Aeritalia ATR 42-300 aircraft, Registration C-FTJB, Serial Number 119, under Air Operator Certificate Number 875.

Conditions

The exemption is subject to the following conditions:

  1. The operator, Bradley Air Services Ltd. (D.B.A. First Air) shall have continuing ownership and direct operation of the subject aircraft;
  2. The operator shall ensure that the aircraft is maintained to a Transport Canada approved inspection and maintenance schedule and the number is entered in the aircraft journey log book prior to operation;
  3. The operator shall ensure that ATR task card First Air 91-001 is added to the A check work package to inspect the wiring in the affected hydraulic bay area;
  4. The operator shall ensure that a copy of this exemption is attached to the Limitation Section of the Aircraft Flight Manual;
  5. The operator shall ensure that, a copy of this exemption is kept in the subject Aircraft’s Technical File;
  6. The operator shall make appropriate entries in the Journey Log and Aircraft Technical file to identify that this exemption is in effect, and the aircraft is serviceable;
  7. The operator shall ensure that a copy of this exemption is carried onboard the aircraft;
  8. The operator shall ensure that the subject aircraft complies with the requirements of any embodied Department of Transport (DOT) approved or accepted design change. Any design change to be embodied on the subject aircraft shall be established by a competent person, to be compatible with any of the limits authorized by this exemption and not to adversely affect the airworthiness of the modified aircraft;
  9. This exemption does not constitute and shall not be used as basis for an airworthiness approval of the current modifications embodied on the subject aircraft.

Validity

This exemption is in effect until the earliest of the following:

  1. October 15, 2005, at 11:59 EDT;
  2. the date on which Aerospatiale - Aeritalia ATR 42-300 aircraft;Registration C-FTJB, Serial Number 119 conforms to the Transport Canada Type Certificate Number A-159;
  3. the date on which any condition set out this exemption is breached; or
  4. the date on which this exemption is cancelled in writing by the Minister, where he is of the opinion that it is no longer in the public interest, or is likely to affect aviation safety.
