EXEMPTION FROM SECTION 523.01, SUBSECTION (2) OF THE CANADIANAVIATION REGULATIONS, AND PARAGRAPH 523-VLA.3 OF THE AIRWORTHINESS MANUAL (First Edition)

Pursuant to paragraph 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Diamond Aircraft Industries Inc., 1560 Crumlin Sideroad, London, Ontario from the requirements of section 523.01, subsection (2) of the Canadian Aviation Regulations (CARs) only with respect to the Maximum Approved Takeoff Mass (Weight) requirements of paragraph 523-VLA.3 of the Airworthiness Manual (First Edition, effective: 30 June 1993).

Paragraph 523-VLA.3 of the Airworthiness Manual limits the Maximum Approved Takeoff Mass (Weight) to not more than 750 kg (1653.5 lbs.).

The details of the above provisions are provided in Appendix A to this exemption.

PURPOSE

The purpose of this exemption is to grant Diamond Aircraft Industries Inc. an approval to certify all DA20-C1 VLA aeroplanes at a Maximum Approved Takeoff Mass (Weight) of not more than 800 kg (1764 lbs).

APPLICATION

This exemption applies to Diamond Aircraft Industries Inc., only to permit certification of all DA20-C1 VLA aeroplanes at a Maximum Approved Takeoff Mass (Weight) of not more than 800 kg (1764 lbs).

CONDITIONS

This exemption is subject to the following condition:

  1. This exemption shall form part of the type certification basis identified on the Type Certificate Data Sheet for the DA20-C1 aeroplane.

VALIDITY

This exemption is in effect until:

  1. The date on which this exemption is cancelled in writing by the Minister where he is of the opinion that the exemption is no longer in the public interest, or that it is likely to affect aviation safety.

Normal, Utility, Aerobatic and Commuter Category Aeroplanes

523.01 (2) The standards of airworthiness for the issuance of a type certificate in respect of a very light aeroplane in the normal or utility category, or for a change to such a type certificate, are those specified in Chapter 523-VLA of the Airworthiness Manual.

523-VLA.3 Very Light Aeroplane Definition

A Very Light Aeroplane is an aeroplane with a single engine (spark or compression ignition), having not more than two seats, with "a Maximum Approved Takeoff Mass (Weight) of not more than 750 kg (1653.5 lbs.) and a stalling speed in the landing configuration of not more than 45 knots Calibrated Air Speed (CAS).

Note: The certification basis for the DA20-C1 aeroplane is the Airworthiness Manual (AWM) 523-VLA, first edition, effective 30 June 1993. Since the subchapter lettering and section numbering used in the first edition of AWM 523-VLA was not consistent with JAR-VLA and other AWM Chapters, AWM 523-VLA has been renumbered. Therefore, the requirements of AWM paragraph 523-VLA.3 quoted in this exemption are equivalent to the requirements of AWM paragraph 523-VLA.1(b), Change 523-VLA-2, effective 1 December 2004.
