Issuance or Amendment of Air Operator Certificate

As there is no requirement in subpart 704 of the CARs for the operator to have a Flight Attendant Manager and due to the number of cabin safety elements imposed on this type of operation, compliance with subparagraph 705.07(2)(b)(iv) of the CARs is required.  The approval process for the Flight Attendant Manager must follow the same process applied to the 705 operators. (See CBAAC 0115R for guidance.)  This approval process is required to determine that the Flight Attendant Manager is aware of their cabin safety responsibilities and accepts those responsibilities.  The purpose is to ensure that there is a single person in the air operator’s organization who is responsible for cabin safety standards and will be the point of contact used by Transport Canada for all cabin safety related regulatory issues.

As per paragraph 725.07(1)(j) of the CASS, Form 26‑0448 Air Operator Certificate Application – Passenger Carrying Authority – Cabin Safety shall be submitted for approval.  The section entitled “Operations With Flight Attendants” shall be completed, with the following exceptions:

  1. Cabin Emergency Evacuation Trainer;
  2. Minimum Number of Flight Attendants per Aircraft Type; and
  3. Carry-on Baggage Control Program.

Seat for Cabin Safety Inspector

As there is no similar provision in subpart 704 of the CARs to provide an inspector with a seat in the cabin, compliance with this section is required for safety oversight and to evaluate compliance with these cabin safety requirements.

Crew Member Briefings

As there is no provision in subpart 704 of the CARs to address crew member briefings and section 602.87 of the Cars is limited in scope, compliance with section 705.31 of the CARs is required.  The air operator shall develop crew member briefing procedures in accordance with this standard.

Flight Attendant Stations

As there is no provision in subpart 704 of the Cars to identify the seating requirements for the carriage of a flight attendant, the basis of approval for the crew member station shall be in accordance with section 705.41 of the CARs.  Section 705.75 of the CARs requires a shoulder harness for the flight attendant.

System

As there is no provision in subpart 704 of the CARs for cabin to flight deck communication systems, compliance with section 705.73 of the CARs is required.

Public Address System

As there is no provision in subpart 704 of the CARs for a public address system, compliance with section 705.74 of the CARs is required.

Flashlights

Paragraph 602.60(1)(e) of the CARs requires a flashlight for each crewmember while section 705.97of the CARs requires the flashlight to be readily available.  As there is no provision in subpart 704 of the CARs for flashlight stowage, compliance with section 705.79 of the CARs is required.

First Aid Kits

As there is no provision in subpart 704 of the CARs relating to the location and marking of the first aid kit required by subsection 724.84(3) of the CARs, compliance with subsections 705.90 (2) and (3) of the CARs are required.

Hand-held Fire Extinguisher

In order to effectively manage any onboard fires with the carriage of a flight attendant and 20 or more passengers, it is deemed essential to have two fire extinguishers in the cabin area.  It is recommended that these extinguishers contain Halon 1211 or approved equivalent.

Flight Attendant Requirements

As there is no provision for the carriage of flight attendants in subpart 704 of the CARs, a flight attendant is required.

Designation of In-charge Flight Attendant

If there are two flight attendants on board then one shall be designated as an In-charge as per section 705.105 of the CARs.

Crew Pairing

As there is no similar provision in subpart 704 of the CARs, crew pairings shall be assigned in accordance with this section.

Flight Attendant Qualifications

As there is no provision for the qualification of a flight attendant in subpart 704 of the CARs, compliance with section 705.109 of the CARs is required.

Validity Period

As there is no provision related to the validity period of “training”, other than annual training, in subpart 704 of the CARs, compliance with subsection 725.113 (5) of the CARs is required.

Training Program

Training for flight attendants is not identified in subpart 704 of the CARs; therefore, it is necessary to identify training requirements based upon existing regulatory requirements in paragraph 704.115(2)(d) of the CARs and supplemented by requirements of subpart 705 of the CARs.  The training elements identified in subsections 724.115(1),(2),(22) and (26) of the CARs shall be supplemented by the training contained within TP 12296, as applicable to the operation. 

The additional training requirement specified in subsection 725.124(39) of the CARs for Crew Resource Management training has been identified as necessary to comply with paragraph 704.115(2)(e) of the CARs and the carriage of a flight attendant.

Approval of the training programs shall remain in accordance with section 704.115 of the CARs.

Flight Attendant Manual

As there is no provision in subpart 704 of the CARs relating to a manual for flight attendants, section 705.139 of the CARs is required.

There is no need to publish a separate document for the use of the flight attendant, provided that the content requirements of TP 12295, as applicable to the operation, are contained within the Operations Manual and the flight attendant is issued with this manual in accordance with subsection 704.122(1) of the CARs.
