EXEMPTION FROM SECTION 602.40 OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt

from the requirement set out in subsection 301.07(9) and section 602.40 of the Canadian Aviation Regulations requiring that no person shall conduct a landing or a take-off in a heavier-than-air aircraft at an aerodrome unless the aerodrome is lighted in accordance with the aerodrome lighting requirements specified in Part III, subject to the following conditions.

PURPOSE

The purpose of this exemption is to allow STARS Aviation Canada Inc. to conduct night vision goggle training to an unlit aerodrome in accordance with CAR 602.40

APPLICATION

This exemption applies to MBB-BK117 aircraft when operated by STARS Aviation Canada Inc. in its operations under Air Operator Certificate number 6273.

CONDITIONS

This exemption is subject to the following conditions:

  1. The training will be conducted as defined in the STARS Aviation Canada Inc. letter dated 03 November 2003, and the flights will be conducted in accordance with the “CONDITIONS TO ENSURE SAFETY” set out in the letter.
  2. Flights will be conducted in accordance with night VFR rules.

VALIDITY

This exemption is in effect from 19 November 2003, until the earliest of:

  1. 01 February 2004;
  2. the date on which any condition set out in this exemption is breached; or
  3. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or is likely to affect aviation safety.
