Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Canadian air operators operating under Subpart 705 of the Canadian Aviation Regulations (CARs) and the pilots working for those air operators from the requirements set out in section 705.82 of the CARs, subject to the terms of this exemption.
Section 705.82 of the CARs states that:
“After June 30, 2008, no person shall conduct a take-off in a transport category aeroplane, or in a non-transport category aeroplane in respect of which a type certificate was issued after December 31, 1964, that is equipped with a flight instrument Pitot heating system unless the aeroplane is also equipped with a Pitot heat indication system that meets the requirements of section 525.1326 of Chapter 525 — Transport Category Aeroplanes of the Airworthiness Manual.”
PURPOSE
The purpose of this exemption is to give Canadian air operators operating under Subpart 705 of the CARs additional time, when required, to complete the installation of a Pitot heat indication system, as required by section 705.82 of the CARs, which came into force on June 30, 2007.
APPLICATION
This exemption applies to Canadian air operators operating aeroplanes under Subpart 705 of the CARs and to the pilots working for those air operators.
CONDITION
This exemption is subject to the following condition:
Air Operators shall complete the installation of the Pitot Heat Indication System on all the affected aeroplanes as soon as practicable, and no later than June 30th, 2009.
VALIDITY
This exemption is in effect until the earliest of the following:
- June 30th, 2009, 23:59 EDT;
- the date on which any condition set out in this exemption is breached;
- the date on which the installation of the Pilot heat indication system is completed; or
- the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
