EXEMPTION FROM SECTION 705.91 OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Air Canada P.O. Box 14000, Saint-Laurent, Québec H4Y 1H4 from the requirement of Section 705.91 of the Canadian Aviation Regulations (CARs), subject to the following conditions.
Section 705.91 stipulates that no person shall operate an aircraft that has a seating configuration, excluding crew seats, of more than 100 unless an emergency medical kit that meets the Commercial Air Service Standards is carried on board the aircraft.

PURPOSE

The purpose of this exemption is to allow Air Canada to conduct a delivery flight of a Boeing 777(B777), aircraft FIN 735, scheduled to depart Seattle on July 27, 2007 for Montreal, without an emergency medical kit on board the aircraft.  This aircraft will be operated pursuant to section 705.16 of the CARs,  with a total of 4 Air Canada employees on board, including the 2 flight crew members.

APPLICATION

This exemption is applicable only to Air Canada’s delivery flight of B777, aircraft FIN 735 scheduled to depart on or around July 27, 2007 from Seattle to Montreal.

CONDITIONS

This exemption is subject to the following conditions:

  1.  Air Canada shall ensure it operates Fin No. 735, from Seattle to Montreal on or around July 27, 2007 with 4 or fewer employees onboard.
  2. A First Aid Kit meeting the requirements of section  705.90  of the CARs iscarried onboard.

VALIDITY

This exemption comes into effect on July 27, 2007 at 00:00 EST and is in effect until the earliest of the following:

  1. August 10, 2007; 23:59 EST;
  2. the date on which the exemption is superseded by an amendment to the Canadian Aviation Regulations or its associated standards; 
  3. the date on which any of the conditions set out in this exemption is breached; or 
  4. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
