EXEMPTION TO SECTIONS 604.03 and 700.02 OF THE CANADIAN AVIATION REGULATIONS (CARS)

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Manitoba Government Air Services Air Ambulance Operation, Hangar T-5, 900 Ferry Road, Winnipeg, Manitoba  R3H 0Y8 known as Lifeflight from the provision of CAR’s 604.03 and 700.02 as it relates to the transportation of medical patients subject to the following conditions.

PURPOSE:

The purpose of this exemption is to permit Lifeflight to operate Cessna 550 and 560 aircraft without holding an Operator Certificate as required by CAR 604.03 and 700.02.

APPLICATION:

This exemption applies to Lifeflight only.

CONDITIONS:

This exemption is subject to the following conditions:

  1. Lifeflight must operate its aircraft in compliance with Annex A and B attached to the exemption dated 29 November 2005;
  2. This exemption applies only to Cessna 550 and 560 aircraft used for Lifeflight medical operations.                  
  3. Lifeflight must operate in accordance with and maintain the Lifeflight Risk
         Management program dated 17 July 1998.

VALIDITY

This exemption is in effect until the earliest of following:

  1. 23:59 (EST) on 15 May 2008;
  2. The date on which any of the conditions set out in this exemption is breached; or
  3. The date on which this exemption is cancelled in writing by the Minister, where he is of the opinion that it is no longer in the public interest or that it is likely to affect aviation safety.
