Exemption From Subparagraph 703.07(2)(b)(ii) Of The Canadian Aviation Regulations

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after having taken into account that the exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt Brampton Flying Club from the requirements of subparagraph 703.07(2)(b)(ii) of the Canadian Aviation Regulations, subject to the conditions set out below.

The subparagraph states that the applicant shall have managerial personnel who have been approved by the Minister in accordance with the Commercial Air Service Standards.

Purpose

The purpose of this exemption is to allow Brampton Flying Club to employ Mr. Richard Wynott, AA142646, as Chief Pilot without having at least 500 hours flight time of which 250 hours is as pilot-in-command within the preceeding 3 years on the same category and class of aircraft being operated as stated in subclause 723.07(2)(b)(i)(B)(II) of the Commercial Air Service Standards.

Conditions

This exemption is subject to the following conditions:

  1. Mr. Wynott shall accumulate the experience requirement of two hundred and fifty hours as pilot-in-command on a multi-engined aircraft within the preceding three years. This requirement must be satisfied no later than June 1, 2003.
  2. Mr. Wynott shall continue to maintain his qualifications on at least one of the multi-engined types to be operated under the authority of Air Operator Certificate No. 1687.
  3. Mr. Wynott shall successfully complete the National Chief Pilot Air Taxi CAR 703 Examination (CPTAX Examination) on or before June 10, 2002.

Validity

This exemption is in effect until the earliest of:

(a) the date on which any of the foregoing conditions is not complied with;

(b) the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or that it is likely to affect aviation safety;

 or

(c) midnight on June 1, 2003.
