Exemption From Subparagraph 703.07(2)(b)(ii) Of The Canadian Aviation Regulations

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Midland Flight Centre Ltd., c/o/b Future Air, P.O. Box 2007 Richmond Hill, Ontario, L4E 1A3, operating under Subpart 3 of Part VII of the Canadian Aviation Regulations (CARs), from the application of Subparagraph 703.07(2)(b)(ii) of the CARs, subject to the following conditions. This Subparagraph requires that an air operator have a Chief Pilot with at least 500 hours flight time of which 250 hours shall be as pilot-in-command within the preceding 3 years on the same category and class of aircraft being operated.

Purpose

The purpose of this exemption is to allow Midland Flight Centre Ltd. to have John Greer, licence no. AA349341, to act as chief pilot when he does not meet the qualifications of Subclause 723.07(2)(b)(i)(B)(II) of the Commercial Air Service Standards (CASS), in that he does not have 250 hours pilot-in-command within the preceding 3 years on the same category and class of aircraft being operated.
Conditions
This exemption is subject to the following conditions:

  1. the size and scope of Midland Flight Centre Ltd. remains the same;
  2. Mr. John Greer, licence no. AA349341, resigns from the position of Person Responsible for Maintenance;
  3. Mr. John Greer, licence no. AA349341, must complete an annual pilot proficiency check with a Transport Canada Inspector.

Validity

This exemption is in effect until the earliest of:

  1. the date on which any of the foregoing conditions is not complied with;
  2. the date on which the Chief Pilot meets the requirements of Subclause 723.07(2)(b)(i)(B)(II), of the Commercial Air Service Standards (CASS);
  3. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or that it is likely to affect aviation safety; or
  4. 23:59 hours local time, March 31, 2007.
