Pursuant to subsection 5.9(2) of the Aeronautics Act, and after having taken into account that the exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt Héli-Boréal Inc., 130 Chambers, Sept-Îles, Quebec, G4R 4W7 from the requirements set out in clause 723.07(2)(b)(i)(B) of the Commercial Air Service Standards (CASS) made pursuant to subparagraph 703.07(2)(b)(ii) of the Canadian Aviation Regulations (CARs), subject to the following condition.
Subparagraph 703.07(2)(b)(ii) of the CARs requires that air operators employ chief pilots who have been approved by the Minister in accordance with the CASS.
Clause 723.07(2)(b)(i)(B) of the CASS states that the chief pilot’s qualifications must include at least 500 hours of flying time as a helicopter pilot-in-command, of which 250 hours shall have been acquired within the preceding three (3) years.
PURPOSE
The purpose of this exemption is to authorize Héli-Boréal Inc., 130 Chambers, Sept-Îles, Quebec, G4R 4W7, which operates under subpart 3 of Part VII of the CARs, to employ a chief pilot who does not meet the requirement of having acquired 250 hours of flying time as a helicopter pilot-in-command in the preceding three (3) years.
This exemption will allow the chief pilot to acquire the 250 hours of flying time as a helicopter pilot-in-command required by the CASS.
APPLICATION
This exemption applies to Mr. Carol Soucy, licence number CH335279, in order for him to act as a chief pilot.
CONDITION
This exemption is subject to the following condition:
- Mr. Carol Soucy must keep a valid pilot proficiency check for the same category and class of aircraft as the aircraft that are authorized under the company’s air operator certificate.
VALIDITY
This exemption is valid until the earliest of the following:
- August 1, 2008 at 23:59 EDT;
- the date on which the condition specified in the exemption is breached;
- the date on which this exemption is cancelled in writing by the Minister where he is of the opinion it is no longer in the public interest, or is likely to adversely affect aviation safety.
