EXEMPTION FROM SUBPARAGRAPH 704.07(2)(b)(ii) of the CANADIAN AVIATION REGULATIONS (CARs)

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Air Satellite Inc, Baie-Comeau Airport, Baie-Comeau, Quebec G5S 2S6, operating under Subpart 4 of Part VII of the Canadian Aviation Regulations (CARs), from the requirements of subparagraph 704.07(2)(b)(ii) of the CARs, under the conditions set out below.

The requirements of subparagraph 704.07(2)(b)(ii) of the CARs and clauses 724.07(2)(b)(i)(E) and (F) of the Commercial Air Service Standards are outlined in Appendix A of this exemption.

PURPOSE

The purpose of this exemption is to allow the air operator, Air Satellite Inc., to employ a chief pilot who does not meet the requirements of having three years experience as pilot-in-command of a commuter aeroplane or line indoctrination training, as required in clauses 724.07(2)(b)(i)(E) and (F) of the Commercial Air Service Standards, in order to restart the operation of its commuter service in accordance with Subpart 4 of Part VII of the Canadian Aviation Regulations (CARs).

APPLICATION

This exemption applies to Beechcraft King Air 100 aircraft when they are operated by Air Satellite Inc., in accordance with its air operator certificate, number 2733.

CONDITIONS

This exemption is subject to the following conditions:

  1. The chief pilot must have at least 1 000 hours of experience as pilot of a multi-engine turbine-powered aeroplane;
  2. Five hundred (500) of those hours must be as pilot-in-command of the same type of aeroplane;
  3. The second-in-command must have at least fifty (50) hours of experience on the type.

VALIDITY

This exemption is in effect until the earliest of the following:

  1. Midnight, EST, December 31, 2007;
  2. The date on which any condition specified in the exemption is breached;
  3. The date on which this exemption is cancelled in writing by the Minister where he is of the opinion it is no longer in the public interest, or is likely to adversely affect aviation safety.

(F) be qualified in accordance with the air operator’s training program to act as pilot-in-command on one of the types to be operated.
