EXEMPTION FROM SUBPARAGRAPHS 725.124 (11)(c)(iii) and (iv) OF THE COMMERCIAL AIR SERVICE STANDARDS MADE PURSUANT TO PARAGRAPH 705.124(1)(b) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Canadian air operators, who are approved to conduct a Level D training program using an approved Level D full flight simulator (FFS), from the training requirements of subparagraphs 725.124(11)(c)(iii) and (iv) of The Commercial Air Service Standards (CASS) made pursuant to paragraph 705.124(1)(b) of the Canadian Aviation Regulations (CARs), subject to the following conditions.

The requirements of subsection 725.124(11) of the CARs – Level C Training Program - and subsection 725.124(12) of the CARs – Level D Training Program – are detailed in Appendix "A" to this exemption. The current verbiage of the CASS requires an air operator using a level D training program to meet the requirements of the level C training program, including the requirements of subparagraphs 725.124 (11)(c)(iii) and (iv) of the CASS, which are already covered in the more demanding requirements of subparagraphs 725.124 (12)(b)(i) and (ii) of the CASS of the level D training program.

Purpose

The purpose of this exemption is to shield air operators conducting Level D training programs from the inadvertent duplication of requirements found in subparagraphs 725.124 (11)(c)(iii) and (iv) of the CASS of the Level C training program.

Application

This exemption applies to Canadian air operators, who are approved to conduct a Level D training program using a Level D full flight simulator.

Conditions

This exemption is subject to the following conditions:

  1. The air operator must have an approved Level D flight training program, using an approved Level D full flight simulator.
  2. The air operator’s training program shall meet all the other requirements set out in subsection 725.124(12) of the CASS.

Validity

This exemption is in effect until the earliest of the following:

  1. September 1, 2007 at 23:59 EDT;
  2. the date on which an amendment to the appropriate provision of the CARs or related Standard comes into effect;
  3. the date on which any of the conditions set out in this exemption is breached; or
  4. the date on which this exemption is canceled in writing by the Minister, where he is of the opinion that it is no longer in the public interest, or it is likely to affect aviation safety.

Appendix A - Commercial Air Service Level C FFS Training Standard - Subsection 725.124(11) and Commercial Air Service Level D FFS Training Standard – Subsection 725.124(12)

(11) Level C Training Program for Pilots other than Cruise Relief Pilots
(amended 2004/12/01; previous version)

  1. An air operator with an approved Level C training program using an approved Level C FFS is permitted zero flight time training for candidates with at least second-in-command experience on a similar aeroplane with the same air operator or has had verifiable line currency as a second-in-command on a similar aeroplane within the previous two years. Candidates who do not qualify shall undergo aeroplane flight training in accordance with those items listed in paragraph 725.124(9)(c).(amended 2004/12/01; previous version)
     
  2. For the purpose of this provision, "similar aeroplane" means both aeroplanes are subject to Subpart 705 of the Canadian Aviation Regulations except where the two types have been grouped for PPC purposes as:
     
    1. turbo-jet to turbo-jet - provided both are certified as Transport Category Aeroplanes;
    2. turbo-prop to turbo-prop - provided both are certified as Transport Category Aeroplanes; and/or
    3. reciprocating to reciprocating - provided both are certified for operations under Subpart 705 of the Canadian Aviation Regulations.
       
  3. In addition to those items of training required in paragraph 725.124(10)(a), and the flight check in PPC Schedule I of section 725.106, training in an approved Level C flight simulator shall include:(amended 2004/12/01; previous version)
     
    1. manoeuvring of the aeroplane on the ground;
    2. crosswind take-offs and landings to 100% of the published crosswind component;
    3. a visual training program in the flight simulator to ensure VFR flight skills, covering scenarios of dusk and night with variable weather and visibilities. This program shall include the following:
       
      1. normal and crosswind take-offs, visual circuits and landings with variable wind, runway illusion and surface conditions;
      2. engine inoperative approach and landing;
      3. engine failure procedures during take-off and missed approach;
      4. no electronic glideslope approach and landing; and
      5. approaches and landings with flight control failures and abnormalities.
         
    4. a simulated line flight comprising at least 2 sectors (one as pilot flying and another as pilot not flying).
       
  4. If a Level C flight simulator has differences in performance, systems, or cockpit layout and configuration from the air operator's aeroplane, additional training on these differences shall be provided.

(12) Level D Training Program for Pilots other than Cruise Relief Pilots

  1. An air operator with an approved Level D training program using an approved Level D FFS is permitted zero flight time training.
     
  2. In addition to the training required for a Level C program, the following FFS training shall be carried out at an appropriate point in the training program.
     
    1. A VFR training program in the Level D flight simulator of at least 4 hours per crew (2 hours as pilot flying and 2 hours of pilot not flying) is required, to ensure visual flight skills to cover either day or dusk and night with variable weather and visibility scenarios. This program shall include the following:
       
      1. normal and crosswind take-offs, and visual circuits and landings, with variable wind, runway illusion and surface conditions;
      2. engine inoperative approach and landing;
      3. engine failure procedures during take-off and missed approach;
      4. no visual aids approaches and landings; and
      5. approaches and landings with flight control failures and abnormalities;

        NOTE:

        Where a pilot demonstrates a satisfactory level of performance in visual manoeuvres, the operator may use the time specified in (i) above as additional training to that required by any of the Level C requirements.
         
    2. Simulated line flights of at least 2 sessions (2 sectors as pilot flying and 2 sectors as pilot not flying) are required. Pilot flying duties shall be carried out from the appropriate seat.
       
  3. If a Level D flight simulator has differences in performance, systems, or cockpit layout and configuration from the air operator's aeroplane, additional training on these differences shall be provided.
