Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt holders of airport certificates that are not listed in subsection 302.500 (1) of the Canadian Aviation Regulations (CARs), from the requirements set out in paragraphs 106.02(1)(a), 106.02(1)(b) and 106.02(1)(c).
Paragraph 106.02(1) (a) requires that the holder of an airport certificate appoint an individual as accountable executive to be responsible for operations or activities authorized under the certificate and accountable on their behalf for meeting the requirements of these Regulations;
Paragraph 106.02(1) (b) requires that the holder of an airport certificate notify the Minister of the name of the person appointed; and
Paragraph 106.02(1) (c) requires that the holder of an airport certificate ensure that the accountable executive submits to the Minister a signed statement that they accept the responsibilities of their position within 30 days after their appointment.
PURPOSE
The purpose of this exemption is to provide more time to the holders of airport certificates to appoint an accountable executive and ensure that the accountable executives appointed in respect of those certificates submit to the Minister the signed statement required pursuant to paragraph 106.02(1)(c).
APPLICATION
This exemption applies to the holders of airport certificates that are not listed in subsection 302.500(1) of the CARs.
CONDITION
This exemption is subject to the following condition:
- The airport certificate holder shall ensure that the accountable executive submits the signed statement required by paragraph 106.02(1)(c) of the CARs before September 1st, 2008.
VALIDITY
This exemption is in effect from 00:01 EST on January 1st, 2008 until the earliest of:
- 00:01 EDT on September 1st, 2008;
- The date on which any of the conditions set out in this exemption is breached; or
- The date on which this exemption is canceled in writing by the Minister, where he is of the opinion that it is no longer in the public interest, or it is likely to affect aviation safety.
