EXEMPTION FROM SUBSECTION 202.15(1) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Cochrane Air Services Limited, Box 1893, Cochrane, Ontario, P0L 1C0, from the requirements set out in subsection 202.15(1) of the Canadian Aviation Regulations.

Subsection 202.15(1) states “Subject to subsection (2), any Canadian is qualified to be the registered owner of a Canadian Aircraft”.

Subsection 202.15(2) states “No individual is qualified to be the registered owner of a Canadian aircraft unless the individual is at least 16 years of age”.

PURPOSE

The purpose of this exemption is to allow Cochrane Air Services Limited to be the registered owner of a Canadian registered aircraft although Cochrane Air Services Limited is not Canadian.

APPLICATION

This exemption applies to the following listed aircraft when operated by Cochrane Air Services Limited in its operations under Air Operator Certificate Number 3474:

  1. C- FHID, Cessna 180 aircraft, serial number 30582;
  2. C-FGBF, deHavilland DHC-2 aircraft, serial number 168;
  3. C-FEYQ, deHavilland DHC-2 aircraft, serial number 465.

CONDITIONS

This exemption is subject to the following conditions:

  1. Cochrane Air Services Limited shall have a valid ORDER EXEMPTING COCHRANE AIR SERVICES LIMITED FROM THE APPLICATION OF SUBPARAGRAPH 61(a)(i) OF THE CANADA TRANSPORTATION ACT, issued by the Minister of Transport;
  2. The Air Operator Certificate issued to Cochrane Air Services Limited, by Transport Canada, shall be valid; and
  3. A copy of this exemption shall be carried on board each aircraft to which the exemption applies.

VALIDITY

This exemption is in effect until the earliest of following:

  1. 23:59 EST on November 1, 2007;
  2. the date on which any condition set out in this exemption is breached; or
  3. the date on which this exemption is cancelled in writing by the Minister of Transport where he is of the opinion that it is no longer in the public interest or is likely to affect aviation safety.
