EXEMPTION FROM SUBSECTION 202.15(2) OF THE CANADIAN AVIATION REGUATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Stone Mountain Safaris Ltd., Box 7870, Toad River, BC VOC 2X0, from the requirements set out in subsection 202.15(1) of the Canadian Aviation Regulations.

Subsection 202.15(1) states "subject to subsection (2), any Canadian is qualified to be the registered owner of a Canadian Aircraft"

Subsection 202.15(2) No individual is qualified to be the registered owner of a Canadian aircraft unless the individual is at least 16 years of age.

Purpose

The purpose of this exemption is to allow Stone Mountain Safaris Ltd. to be the registered owner of a Canadian registered aircraft although Stone Mountain Air Safaris is not Canadian. 

Application

This exemption applies to the following aircraft when operated by Stone Mountain Safaris Ltd in its operation under Air Operator Certificate Number 5790:

Cessna 305A aircraft, serial number 2025.

Conditions

The exemption is subject to the following conditions:

  1. Stone Mountain Safaris Ltd. Shall meet all the conditions of the ORDER EXEMPTING STONE MOUNTAIN SAFARIS LTD FROM THE APPLICATION OF SUBPARAGRAPH 61(a)(i) F THE CANADA TRANSPORTATION ACT, issued by the Minister of Transport of 11 May 2006;
  2. The Air Operator Certificate issued to Stone Mountain Safaris Ltd by Transport Canada, shall be valid; and
  3. A copy of this exemption shall be carried on board the aircraft.

Validity

This exemption is in effect until the earliest of following:

  1. Pacific Standard Time at 11:59 on 31 October 2010;
  2. the date on which any condition set out in this exemption is breached; or
  3. the date on which this exemption is cancelled in writing by the Minister of Transport where he is of the opinion that it is no longer in the public interest or is       likely to affect aviation safety.
