EXEMPTION FROM SUBSECTION 202.42(1) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to Section 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Fast Air Limited, 80 Hanger Line Road Winnipeg, Manitoba R3J 3Y7 from the provisions of subsection 202.42(1) of the Canadian Aviation Regulations, requiring that a foreign registered aircraft may only be present in Canada for no more than 90 days in any 12 month period. 

Purpose

The purpose of this exemption is to permit Fast Air Limited to operate a foreign registered King Air 200 aircraft, serial number BB1428, registration N660MW, that has been present in Canada for a period of more than 90 days in the immediately preceding twelve month period for the sole purpose of removing it from Canada and returning it to the United States of America.

Application

This exemption is granted to Fast Air Limited only when operating the foreign registered King Air 200, registration N660MW.

Conditions

This exemption is subject to the following conditions:

1. The use of the aircraft shall be restricted to a single flight from Winnipeg, Manitoba to Grand Forks, Montana prior to July 31, 2007.

2. A copy of this exemption shall be attached to the Certificate of Registration for the aircraft.

Validity

This exemption is in effect until the earliest of:

1. July 31, 2007, 23:59 CST;
2. The date on which any condition specified in this exemption is breached;
3. The date on which the registration of the aircraft is cancelled or suspended; or
4. The date on which the exemption is canceled in writing by the Minister where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
