EXEMPTION FROM SUBSECTION 202.42(1) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to Section 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Spectrem Air Ltd., Box 457, Lanseria 1748, South Africa, (a wholly owned subsidiary of Anglo American Corporation) from the provisions of subsection 202.42(1) of the Canadian Aviation Regulations, requiring that a foreign registered aircraft may only be present in Canada for no more than 90 days in any 12 month period. 

Purpose

The purpose of this exemption is to permit Spectrem Air Ltd. to operate a foreign registered aircraft in Canada for a period of 5 months, only for the purposes of geological surveys in support of Hudson Bay Exploration Inc, AngloGold, DeBeers, and Anglo Platinum (all subsidiaries of Anglo American Corporation).

Application

This exemption is granted to Spectrem Air Ltd for the operation of a South African registered DC3 aeroplane, registration ZS-ASN in Canadian airspace.

Conditions

This exemption is subject to the following conditions:

  1. Operation of the aircraft shall only be for the purposes of aerial survey work on behalf of Hudson Bay Exploration Inc, AngloGold, DeBeers, and Anglo Platinum.
  2. Only personnel essential to the operation of the aircraft and its systems shall be carried on board the aircraft.
  3. All Canadian Aviation Regulations shall be complied with while flying in Canadian airspace.
  4. All flights shall be conducted in accordance with a valid Validation of Foreign Flight Authority issued by Transport Canada.
  5. A copy of the Validation of Foreign Flight Authority shall be carried on board the aircraft.
  6. A copy of this exemption shall be attached to the Certificate of Registration for the aircraft and carried on board.

Validity

This exemption is in effect until the earliest of:

  • January 1, 2007 at 00:01 CST;
  • The date on which any condition specified in this exemption is breached;
  • The date on which the registration of the aircraft is cancelled or suspended; or
  • The date on which the exemption is canceled by the Minister, in writing, where he is of the opinion that it is no longer in the public interest or that it is likely to affect aviation safety.
