EXEMPTION FROM SUBSECTION 421.35(5) OF THEPERSONNEL LICENSING AND TRAINING STANDARDS RESPECTING FLIGHT CREW PERMITS, LICENCES AND RATINGS AND SECTION 401.35 OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt applicants for the issue of an Airline Transport Pilot Licence – Helicopter from completing the skill requirement as set out in subsection 421.35(5) of the Personnel Licensing and Training Standards Respecting Flight Crew Permits, Licences and Ratings, made pursuant to section 401.35 of the Canadian Aviation Regulations, in accordance with the purpose and application set out below and subject to the following condition.

Subsection 421.35(5) states that within the 12 months preceding the date of application for a licence, an applicant shall demonstrate in flight and on the ground familiarity with and the ability to perform, as a pilot-in-command of a helicopter required to be operated with a co-pilot, both normal and emergency procedures and manoeuvres appropriate to the privileges of an Airline Transport Pilot Licence – Helicopter.

Purpose

The purpose of this exemption is to permit Airline Transport Pilot Licence – Helicopter applicants to complete the skill test requirement either in the helicopter or in an approved  helicopter simulator certified to level B or higher. This exemption is required because the current standard does not provide for the completion of the skill test requirement in an approved helicopter simulator.

Application

This exemption applies to all helicopter applicants wishing to complete the skill requirement for issue of an Airline Transport Pilot Licence – Helicopter.

Conditions

This exemption is subject to the following condition:

Applicants for an Airline Transport Pilot Licence – Helicopter, shall complete within 12 months preceding the date of application for a licence, the skill test requirement in either a helicopter required to be operated with a co-pilot, or in a Transport Canada approved simulator certified to level B or higher, representative of that helicopter type.

Validity

  This exemption is in effect until the earliest of the following:

  1. the date on which any condition set out in this exemption is breached;
  2. the date on which an amendment to the appropriate provision of the Canadian Aviation Regulations comes into effect; or
  3. the date on which this exemption is canceled in writing by the Minister where he is of the opinion that it is no longer in the public interest or is likely to affect aviation safety.
