EXEMPTION FROM SUBSECTION 507.02(b) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt

from the requirement set out in subsection 507.02(b) of the Canadian Aviation Regulations requiring that the aircraft "conforms to its certified type design", subject to the following conditions.

Purpose

The purpose of this exemption is to allow Millar Western Industries Ltd. to operate a BAe 125-800A in a configuration which does not conform to the certification basis of the aircraft's type design. In particular, Service Bulletin 27-I54-2994C, an airbrake/lift dump baulk to prevent selection of lift dump in flight and selection of airbrakes when flaps are extended to or beyond 15° position, is not installed as required by Transport Canada Type Certificate A-145.

Application

This exemption applies to British Aerospace BAe 125-800A model aircraft, serial number 258239, registered in Canada C-GMLR when operated by Millar Western Industries Ltd. under Private Operating Certificate No. P-8770.

Conditions

This exemption is subject to the following conditions:

  1. modification kit has been ordered;
  2. Flight Manual Particular Revision HS 1.16 P/6, if already included in the aircraft basis AFM will not be applicable until the associated Service Bulletin 27-154-2994C is incorporated; and
  3. the exemption is valid until October 8, 2000.

Validity

This exemption is in effect until the earliest of the following:

  1. PDT at midnight on October 8, 2000,
  2. the date on which airbrake/lift dump baulk is installed, or
  3. the date on which this exemption is canceled in writing by the Minister where he is of the opinion that it is no longer in the public interest or is likely to affect aviation safety.
