EXEMPTION FROM SUBSECTION 571.11(1) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and not likely to affect aviation safety, I hereby exempt holders of an Aircraft Maintenance Engineer (AME) licence, endorsed with either an M1 or M2 aircraft rating. from the requirement in subsection 571.11(1) of the Canadian Aviation Regulations (CARS), subject to the conditions enumerated below. CAR 571.11(1) states that no person other than the holder of an Aircraft Maintenance Engineer (AME) licence issued under Part IV, specifying a rating appropriate to the aeronautical product being maintained, shall sign a maintenance release.

Purpose:

The purpose of this exemption is to allow holders of either an M1 or M2 rated AME licence to sign a maintenance release without holding a rating appropriate to the aeronautical product being maintained. This will enable either M1 or M2 rated AME licence holders to sign maintenance releases in respect of the maintenance of turbine-powered helicopters and SFAR41C aeroplanes, including their associated Commuter Category variants and derivatives.

Application:

This exemption applies to all holders of Canadian AME 1icences endorsed with either an M1 or M2 aircraft rating when signing maintepance releases for turbine-powered helicopters and the following aeroplanes, including their variants and derivative models approved pursuant to SFAR 41C or Airworthiness manual 523 Commuter Category:

British Aerospace Jetstream Series 3200, Model 3212
Dornier Models: 228-201/228-202

Conditions:

This exemption shall be subject to the following conditions:

  1. The AME shall comply with the applicable provisions of all Canadian aviation documents issued pursuant to the Aeronautics Act.
  2. The AME shall comply with all other applicable Canadian Aviation Regulations, and in particular with all other requirements set out in Section 571.11 of the Canadian Aviation Regulations in respect of persons who may sign a maintenance release.

Validity:

This exemption is in effect until the earliest of the following:

  1. EST at midnight December 31, 2002;
  2. the date on which any condition set out in this exemption is breached;
  3. the date on which an amendment to the appropriate provisions of the Canadian Aviation Regulations come into effect; or
  4. the date on which this exemption is canceled in writing by the Minister where he is of the opinion that it is no longer in the public interest, or is likely to affect aviation safety.
