EXEMPTION FROM SUBSECTION 700.22(1) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to Subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Canadian air operators and Flight Crew Members conducting on-demand charter MEDEVAC operations pursuant to Subpart 704 of the Canadian Aviation Regulations (CARs) from the requirements set out in Subsection 700.22(1) of the CARs, subject to the conditions below.

This regulation requires that those flights or series of flights that terminate more than four one-hour time zones from the point of departure, be limited to three (3) sectors.

Purpose

The purpose of this exemption is to allow Canadian air operators conducting on-demand charter MEDEVAC operations under Subpart 704 of the CARs to conduct long-range flights of up to a maximum of four (4) sectors in order to complete medical evacuation operations.

Application

This exemption applies to Canadian air operators and Flight Crew Members conducting on-demand charter MEDEVAC operations pursuant to Subpart 704 of the CARs subject to the conditions below.

Conditions

This exemption is subject to the following conditions:

  1. All long-range flights shall be limited to a maximum of four (4) sectors;
  2. The air operator shall provide the flight crew member with a rest period of at least sixteen (16) hours following any long-range flight of four (4) sectors duration; and
  3. A copy of the exemption shall be carried on board the aircraft.

Validity

This exemption is in effect until the earliest of the following:

  1. The date on which an amendment to the appropriate provisions of the CARs comes into effect;
  2. The date on which any of the conditions set out in this exemption is breached; or
  3. The date on which this exemption is cancelled, in writing, by the Minister, where he is of the opinion it is no longer in the public interest or is likely to affect aviation safety.
