Pursuant to subsection 5.9(2) of the Aeronautics Act, and after having taken into account that the exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt Equipe de Voltige Northern Lights Inc./Northern Lights Aerobatic Team Inc., 706, 7e Avenue, Ste-Foy, Quebec, Canada from the requirements set out in subsection 702.08 of the Canadian Aviation Regulations (CARs) that an Air Operator Certificate (AOC) shall contain specific conditions with respect to the types of aircraft authorized and, if applicable, their registration, and any operational restrictions.
Purpose and Application
The purpose of this exemption is to allow Équipe de Voltige Northern Lights Inc./ Northern Lights Aerobatic Team Inc. to operate its Aero Vodochody L-39 aeroplanes, registrations C-GIVZ and C-GIVS, to conduct Combat Air Support for the Canadian Armed Forces under the Canadian Aviation Regulations (CARs) Part VII subpart 2.
Conditions
- This exemption is subject to the observance and performance by the air operator of the conditions of the exemption. This exemption may be suspended or cancelled at any time by the Minister in writing where he is of the opinion that it is no longer in the public interest or it is likely to affect aviation safety or for cause, including failure on the part of the air operator, his servants or agents to comply with the provisions of the Aeronautical Act, the Canadian Aviation Regulations (CARs) or any of the conditions of this exemption.
- No change in the operation or type of aircraft shall be made by the operator without first obtaining authorization from the Minister.
- Nothing in this exemption shall be held to relieve the air operator from compliance with the provisions of such Canadian aviation documents as may have been issued pursuant to the Aeronautical Act.
- The aircraft shall have a valid Canadian Flight Authorization (Flight Permit, Specific Purpose, Combat Air Support).
- This exemption shall be used in conjunction with the air operator established operating procedures and is contingent on all training and qualification requirements in the operations manual having been met, in accordance with the provisions 722.76 of the CASS made pursuant to paragraph 702.76 of the Canadian Aviation Regulations (CARs).
- A copy of this exemption shall be carried on board the aircraft
Validity
This exemption is in effect until the earliest of the following:
- Indeterminate period while the aircraft is in the care, custody and control of NLAT;
- The date on which any of the conditions set out in the Schedule of Conditions attached to this exemption is breached; or
- The date on which this exemption is cancelled in writing, by the Minister, where he is of the opinion it is no longer in the public interest, or that it is likely to affect aviation safety.
