EXEMPTION FROM SUBSECTION 704.108 (1) (c) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act,and after having taken into account that the exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt an air operator, SAGGAS INTERNATIONAL AERONAUTICS SERVICES INC./SERVICES AERONAUTIQUES SAGGAS INTERNATIONAL INC. c/o/b SAGGAS International, 475 Dumont Street, Suite 201 Dorval, Quebec H9S 5W2 from the requirements set out subsection 704.108 (1) (c) of the Canadian Aviation Regulations (CAR's). The requirements set out in CAR's subsection 704.108 (1) (c) requires that persons have successfully completed a Pilot Proficiency Check (PPC), the validity period of which has not expired, for that type of aircraft, in accordance with the Commercial Air Service Standards(CASS);

Purpose

The purpose of this exemption is to extend the airborne requirement of the PPC to be completed within the period stated in subsection 724.108 (1) Schedule I of the CASS.

Application

This exemption only applies to the following flight crew members when operating for SAGGAS International under Air Operator Certificate number 10436 currently under certification.

1. Mr. Edwin Houston - Licence number AA159211
2. Mr. Yvon Laforge — Licence number AA 121800
3. Mr. Ronald MacDorman — Licence number AA220113
4. Mr. Roger Foster — Licence number AA383903

Conditions

This exemption is granted subject to the following conditions:

1. This exemption is valid only if the pilots successfully complete the training set out in the Company Training Manual and complete a PPC on a Full Flight Simulator.
2. In addition to the requirement of two hours of airborne training after the Full Flight Simulator PPC, the pilots will receive two extra hours of airborne flight training before completing the airborne portion of the PPC.

This exemption is in effect until the earliest of the following:

1. September 15th' 2004 at 23:59 EDT;
2. The date on which the PPC is completed on the aeroplane;
3. The date on which one of the conditions set out in the exemption is breached;
4. The date on which this exemption is canceled, in writing by the Minister, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
