Exemption from subsection 725.95(2) of the Commercial Air Service Standards made pursuant to section 705.95 of the Canadian Aviation Regulations

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to adversely affect aviation safety or security, I hereby exempt Canadian air operators operating under Subpart 5 of Part VII of the Canadian Aviation Regulations (CARs), from the requirements set out in subsection 725.95(2) of the Commercial Air Service Standards (CASS) made pursuant to section 705.95 of the CARs, subject to the following conditions.

Relevant provisions of the CARs and CASS are reproduced in Appendix A.

Purpose

The purpose of this exemption is to allow Canadian air operators operating under Subpart 5 of Part VII of the CARs to be exempt from the requirement to carry some of the additional over water survival equipment listed in subsection 725.95(2) of the CASS, including a radar reflector, two day potable water supply, fishing kit, and allow for the stowage of motion sickness pills in a supplemental survival kit.

Application

This exemption applies to Canadian air operators operating under Subpart 5 of Part VII of the CARs when conducting flights over water.

This exemption ceases to apply to the Canadian air operator who breaches a condition of the exemption.

Conditions

This exemption is subject to the following conditions:

  1. Where life rafts are required to be carried in accordance with section 602.63 of the CARs they shall be equipped with an attached survival kit containing at least the following:
    • a) a pyrotechnic signalling device;
    • b) a life raft repair kit;
    • c) a bailing bucket and sponge;
    • d) a signalling mirror;
    • e) a whistle;
    • f) dye marker;
    • g) a waterproof flashlight;
    • h) a supply of potable water – based on 500 ml per person and calculated using the rated capacity of the life raft – or a means of desalting or distilling salt water that can provide 500 ml of potable water per person at the rated capacity of the life raft;
    • i) a book on sea survival; and
    • j) a first aid kit containing antiseptic swabs, burn dressing compresses, bandages and motion sickness pills.
  2. Despite condition (1), where there is insufficient space within the attached survival kit, a supplemental survival kit shall be stored adjacent to each required life raft that contains:
    • a) a supply of potable water – based on 500 ml per person and calculated using the rated capacity of the life raft – or a means of desalting or distilling salt water that can provide 500 ml of potable water per person at the rated capacity of the life raft, and
    • b) motion sickness pills.

Validity

This exemption is in effect from June 16, 2020 at 00:01 EDT and valid until the earliest of:

  • a) June 15, 2025 at 23:59 EDT; or
  • b) The date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or is likely to adversely affect aviation safety or security.

    • (b) a radar reflector;
    • (c) a life raft repair kit;
    • (d) a bailing bucket and sponge;
    • (e) a signalling mirror;
    • (f) a whistle;
    • (g) a raft knife;
    • (h) an inflation pump;
    • (i) dye marker;
    • (j) a waterproof flashlight;
    • (k) a two day supply of water, calculated using the overload capacity of the raft, consisting of one pint of water per day for each person or a means of desalting or distilling salt water sufficient to provide an equivalent amount;
    • (l) a fishing kit;
    • (m) a book on sea survival; and
    • (n) a first aid kit containing antiseptic swabs, burn dressing compresses, bandages and anti-motion sickness pills.
