EXEMPTION FROM SUBSECTION 801.01(2) AND PARAGRAPH 801.08(b) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, I hereby exempt NAV CANADA, 77 Metcalfe Street, Ottawa, Ontario KIP 5L6, from the requirements of subsection 801.01(2) and paragraph 801.08 (b) for the following purpose, in accordance with the application set out below, and subject to the following conditions.

PURPOSE AND APPLICATION OF EXEMPTION

The purpose of this exemption is to allow air traffic controllers to issue an air traffic control clearance or an air traffic control instruction not in accordance with the Canadian Domestic Air Traffic Control Separation Standards.

This exemption is applicable only to the provision of reduced angular divergence of air traffic control separation pertaining to simultaneous parallel instrument departure operations (SPID), under the conditions set out below.

CONDITIONS OF EXEMPTION

This exemption is granted to NAV CANADA under the following conditions.

  1. NAV CANADA may conduct a trial for reduced angular divergence between simultaneous parallel instrument departure only under VMC conditions.
  2. Air traffic controllers must assign to both aircraft headings based on the methodology for reduction of angular divergence immediately after take-off.
  3. Radar identification of both aircraft must be established within one mile of the end of the runway.
  4. A maximum range of 60 miles must be displayed on the radar indicator module.
  5. Air traffic controllers must not clear or permit an aircraft to turn towards the departure path of another, unless another form of separation has been achieved.
  6. NAV CANADA must forward a copy of the data gathered and the analysis conducted during the trial to the appropriate Transport Canada Regional office on a bi-weekly basis.

EXEMPTION VALIDITY

This exemption is in effect until the earliest of the following:

  1. the date on which an amendment to the appropriate provision of the Canadian Domestic Air Traffic Control Separation Standards comes into effect;
  2. the date on which any of the foregoing conditions is breached; or
  3. the date on which this exemption is cancelled, in writing, by the Minister of Transport, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
