EXEMPTION FROM SUBSECTION 803.02(a) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt NAV CANADA, P.O. Box 3411, Station 'D,' Ottawa, Ontario, K1P 5L6, Canada, from the requirements set out in section 2.6.1, Chapter 2, Volume 3, of the Criteria for the Development of Instrument Procedures (TP 308), made pursuant to subsection 803.02(a) of the Canadian Aviation Regulations (CARs), subject to the following conditions.

Subsection 803.02(a) of the CARs requires that instrument procedures be developed in accordance with the standards and criteria specified in TP 308, which states the following with respect to Threshold Crossing Height (TCH) for an Instrument Landing System (ILS) approach:

“2.6 Glide Slope Threshold Crossing Height Requirements

2.6.1 Category I Threshold Crossing Height (TCH) Requirements

  1. Standard. The glide slope should be located considering final approach obstructions and achieving TCH values associated with the greatest Table 2‑3 wheel height group applicable to aircraft normally expected to use the runway. The TCH should provide a 30‑foot wheel crossing height (WCH).
  2. Deviations from Standard. The TCH shall provide a WCH of no less than 20 feet or greater than 50 feet for the appropriate wheel height group. These limits shall not be exceeded unless formally approved by a Ministerial Authorization, or an Exemption issued by Transport Canada, AARN or the appropriate Military Authority.
    Note: 60 feet is the maximum TCH.
  3. Displaced Threshold Considerations. The TCH over a displaced threshold can result in a WCH value of 10 feet if the TCH over the beginning of the full strength runway pavement suitable for landing meets Table 2‑3 TCH requirements.”

PURPOSE

The purpose of this exemption is to permit NAV CANADA to operate the Glide Path of the ILS at Dryden Regional aerodrome, Ontario, with a TCH of 62.6 feet when the maximum is 60 feet, until the replacement of the ILS in the Spring of 2008 when the TCH will be returned to the current 55 feet value by relocating the Glide Path equipment.

APPLICATION

This exemption applies to the TCH of the ILS runway 11 in Dryden Regional aerodrome, Ontario.

CONDITIONS

This exemption is subject to the following conditions:

  1. NAV CANADA shall operate the Glide Path of the ILS at Dryden Regional with a TCH of 62.6 feet;
  2. NAV CANADA shall publish the Threshold Crossing Height (TCH) of 62.6 feet as part of the Profile View of the approach plate; and
  3. NAV CANADA shall publish a note on the approach plate to the effect that the remaining distance after touchdown is reduced by 50 feet when using the ILS. This note shall also reflect that this reduction is due to a higher than normal Threshold Crossing Height (TCH) of  62.6 feet.

VALIDITY

This exemption is in effect until the earliest of the following:

  1. November 19, 2008, 23:59 EST;
  2. the date on which any condition set out in this exemption is breached; or
  3. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or is likely to affect aviation safety.
