Exemption from Subsections 723.82(2) and 724.84(3) and Section 725.90 of the Commercial Air Service Standards made pursuant to Sections 703.82, 704.84 and 705.90 Of The Canadian Aviation Regulations

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to adversely affect aviation safety, I hereby exempt Canadian air operators operating under subparts 703, 704, or 705 of the Canadian Aviation Regulations (CARs)from the requirements set out in subsections 723.82(2) and 724.84(3) and section 725.90 of the Commercial Air Service Standards (CASS), made pursuant to sections 703.82, 704.84 and 705.90 of the CARs, subject to the conditions set out below.

Subsections 723.82(2) and 724.84(3) of the CASS state, in part, that a “...first aid kit … shall contain the supplies and equipment for a Type A kit set out in Schedule II of Part X of the Aviation Occupational Safety and Health Regulations…”

Section 725.90 of the CASS states, in part, that a “...first aid kit ... shall contain the supplies and equipment for a Type B kit set out in Part X, Schedule II of the Aviation Occupational Safety and Health Regulations…”

Subsections 723.82(2) and 724.84(3) and section 725.90of the CASS are reproduced in Appendix A.

PURPOSE

The purpose of this exemption is to allow Canadian air operators operating under subparts 703, 704, or 705 of the CARs, to carry first aid kits on board the aircraft that contain the supplies and equipment set out in Part 9 of the Aviation Occupational Health and Safety Regulations (SOR/2011-87) rather than Part X of the Aviation Occupational Safety and Health Regulations (SOR/87-182) (Repealed by SOR/2011-87).

APPLICATION

This exemption applies to a Canadian air operatoroperating under subpart 703, 704, or 705 of the CARs.

CONDITIONS

This exemption is subject to the following condition:

  1. 1. Each first aid kit required by paragraph 602.60(1)(h) and carried on board an aircraft operated pursuant to Subpart 3, 4 or 5 of Part VII shall contain the supplies and equipment set out in Part 9 of the Aviation Occupational Health and Safety Regulations (SOR/2011-87).

VALIDITY

This exemption is in effect until the earliest of:

  1. a) February 28, 2021 at 23:59 (EDT);
  2. b) the date on which the condition set out in this exemption is breached;
  3. c) the date on which subsections 723.82(2) and 724.84(3) and section 725.90 of the CASS are amended to specifically address the purpose of this exemption; or
  4. d) the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or it is likely to adversely affect aviation safety.

APPENDIX A

Relevant provisions of the CARs

602.60 Requirements for Power-driven Aircraft

  1. (1) No person shall conduct a take-off in a power-driven aircraft, other than an ultra-light aeroplane, unless the following operational and emergency equipment is carried on board:
    1. (a) […]
    2. (h) a first aid kit.

703.82 Equipment Standards and Inspection

No air operator shall operate an aircraft unless the emergency equipment carried on board the aircraft pursuant to Division II of Subpart 2 of Part VI meets the Commercial Air Service Standards and is inspected regularly in accordance with the inspection schedule set out in the air operator’s company operations manual.

704.84 Equipment Standards and Inspection

No air operator shall operate an aircraft unless the emergency equipment carried on board the aircraft pursuant to Division II of Subpart 2 of Part VI or this Division meets the Commercial Air Service Standards and is inspected regularly in accordance with the inspection schedule set out in the air operator’s company operations manual.

705.90 First Aid Kits

  1. (1) No person shall operate an aircraft unless the following number of first aid kits that meet the Commercial Air Service Standards are carried on board the aircraft:
    1. (a) 0 to 50 passenger seats, one kit;
    2. (b) 51 to 150 passenger seats, two kits;
    3. (c) 151 to 250 passenger seats, three kits; and
    4. (d) 251 or more passenger seats, four kits.
  2. (2) First aid kits shall be
    1. (a) distributed throughout the aircraft cabin;
    2. (b) readily available to crew members and passengers;
    3. (c) clearly identified;
    4. (d) marked with the date of the last inspection; and
    5. (e) where the aircraft is equipped with only one first aid kit, located as close as practicable to an emergency exit.
  3. (3) A stowage compartment that contains a first aid kit shall be clearly marked as to its contents.

In addition, each kit shall contain one pair of protective non-permeable gloves made of latex or equivalent material.

A first aid kit required by section 705.90 of the Canadian Aviation Regulations shall contain the supplies and equipment for a Type B kit set out in Part X, Schedule II of the Aviation Occupational Safety and Health Regulations (AOSH). In addition, each kit shall contain one pair of protective non-permeable gloves made of latex or equivalent material.
