Whereas, pursuant to subsection 30(1) of the Transportation of Dangerous Goods Act, 1992 Emergency Response Task Force , a copy of the proposed Regulations Amending the Transportation of Dangerous Goods Regulations, substantially in the form set out in the annexed Regulations, was published in the Canada Gazette, Part I, on November 20, 2004 and a reasonable opportunity was thereby afforded to interested persons to make representations to the Minister of Transport with respect to the proposed Regulations;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 27 of the Transportation of Dangerous Goods Act, 1992 Emergency Response Task Force , hereby makes the annexed Regulations Amending the Transportation of Dangerous Goods Regulations.

 

 

REGULATIONS AMENDING THE TRANSPORTATION OF DANGEROUS GOODS REGULATIONS

 

 

AMENDMENTS

 

1. The portion of items 15, 16, 24 and 34 of the table to paragraph 1.3(2)(f) of the Transportation of Dangerous Goods Regulations1 in column 2 is replaced by the following:

2. The definitions "IMDG Code" and "Supplement to the ICAO Technical Instructions" in section 1.4 of the Regulations are replaced by the following:

IMDG Code
means Volumes 1 and 2 of the "International Maritime Dangerous Goods Code", 2002 Edition, including Amendment 31-02, published by the International Maritime Organization (IMO). (Code IMDG)
Supplement to the ICAO Technical Instructions
means the Supplement to the "Technical Instructions for the Safe Transport of Dangerous Goods by Air", 2003-2004 Edition, published by the International Civil Aviation Organization (ICAO). (Supplément aux Instructions techniques de l'OACI)
 

3.Section 3.5 of the Regulations is amended by adding the following after subsection (6):

(7)Despite subparagraph (1)(c)(v), the UN number required in the description of each of the dangerous goods may be included in the shipping document before the shipping name.

For example, UN1203, GASOLINE, Class 3, PG II

4. (1)Subparagraph 5.10(1)(a)(i) of the Regulations is replaced by the following:

(i) CSA B340, except clauses 4.1.1.1, 5.1.3(a)(ii) and 5.1.4(a),

(2)Subparagraph 5.10(1)(b)(i) of the Regulations is replaced by the following:

(i)CSA B340, except clauses 4.1.1.1, 5.1.3(a)(ii) and 5.1.4(a),

(3)Paragraph 5.10(1)(c) of the Regulations is replaced by the following:

(c)for transport by aircraft, CSA B340, except clauses 4.1.1.1, 5.1.3(a)(ii) and 5.1.4(a);

(4)Subparagraph 5.10(1)(d)(i) of the Regulations is replaced by the following:

(i)CSA B340, except clauses 4.1.1.1, 5.1.3(a)(ii) and 5.1.4(a),

(5)Subsection 5.10(4) of the Regulations is replaced by the following:

(4)An inspector referred to in CSA B339 who prepares a certificate of compliance and test report that is referred to in clause 4.18 of that standard must give a copy of the report to the manufacturer of the means of containment. The inspector and the manufacturer must each keep a copy of the report for 3 years for a means of containment that is a specification TC-39M cylinder and for 15 years for all other means of containment.

(6)Subsection 5.10(6) of the Regulations is repealed.

COMING INTO FORCE

5.These Regulations come into force on the day on which they are registered.
