What does the Office of Reconsideration do?
The Office of Reconsideration reviews the requests of marine workers who require a Transportation Security Clearance to work, but who have had their Clearance refused or cancelled by Transport Canada. Further to the application and review of the file, the Office of Reconsideration makes a recommendation to the Minister to either confirm or change his decision. The Minister then decides whether or not to grant Clearance to the applicant.
Who can apply for reconsideration?
Anyone whose Clearance has been refused or cancelled under the Marine Transportation Security Regulations.
When do I apply?
You have thirty (30) days from the time you received your Refusal or Cancellation Letter from Transport Canada to submit your application to the Office of Reconsideration.

How do I apply for reconsideration?
To have your application reviewed by the Office of Reconsideration, complete and submit an Application to the Office of Reconsideration under the Marine Transportation Security Clearance Program Form.
Who will make the decision?
Once an application is received by the Office of Reconsideration, it will be reviewed and evaluated by an independent advisor. Based on the advisor's report, the Office of Reconsideration will make a recommendation to the Minister, who ultimately reconsiders the decision to refuse or cancel a Clearance.
Can I seek assistance from the Transportation Appeal Tribunal of Canada?
No, this is not permitted under current legislation. However, there are other options for you to consider.
What if I need help completing my application to the Office of Reconsideration?
You can designate another person to apply for reconsideration on your behalf by completing and returning a Designate Form. By doing this, you are identifying one person, other than yourself, who can represent you and communicate with the Office of Reconsideration on your behalf.
For example, should your level of written English or French prevent you from completing the application form, you may request help from a friend, fellow worker or family member. That person can either help you fill out the form in your own name, or you can identify him or her as someone to represent you in the reconsideration process.

Applicants can help the review process move quickly by ensuring that the information on and submitted with the application is well documented and legible.
