Step 1

An application to safely load onto/unload from vessels more than 10,000 tonnes of Group C Ammonium Nitrate Based Fertilizer (Group C ANBF) is submitted by a port authority to the Executive Director, Navigation Safety and Environmental Programs.

Step 2

The Manager, Port State Inspections and Cargoes verifies the completeness of the application including any information provided by the port authority in support of the claim of having the capacity to safely handle more than 10,000 tonnes of Group C ANBF (e.g. risk assessment, description of stowage facilities, safety and security procedures, emergency preparedness procedures, firefighting capabilities, personnel training, drills, etc.).

Step 3

If necessary, upon request by the Manager, Port State Inspections and Cargoes, checks of the stowage facilities and the other related infrastructure are carried out by the local TCMSS office on site.

Step 4

Upon successful verification of the application, the Executive Director, Navigation Safety and Environmental Programs issues a letter to the port authority to confirm that the ability to safely handle the specified quantity of Group C ANBF was demonstrated to the satisfaction of Transport Canada.

2 Purpose

2.1 This procedure is in support of the Tier I Policy on Loading or Unloading of Ammonium Nitrate Based Fertilizer (ANBF) in a Canadian Port.

2.1 The purpose of this procedure is to describe the process of processing the applications to safely load onto/unload from vessels more than 10,000 tonnes of Group C ANBF submitted by port authorities in accordance with the Tier I Policy.

3.1 The Canada Shipping Act, 2001, paragraph 11(2) (e).

3.2 The Cargo, Fumigation and Tackle Regulations (CFTR), paragraph 114 (1) (b).

4 Background

5 Scope

5.1 This procedure applies in a situation when a port authority claims having the capacity to safely handle more than 10,000 tonnes of Group C ANBF.

6 Responsibility

6.1 The Manager Port State Inspections and Cargoes, Navigation Safety and Environmental Programs, is accountable for the development, implementation, maintenance and continuous improvement of the procedure.

7 Procedure

7.1 An application to safely load onto/unload from vessels more than 10,000 tonnes of Group C Ammonium Nitrate Based Fertilizer (Group C ANBF) is submitted by a port authority to the Executive Director, Navigation Safety and Environmental Programs.

7.2 The application shall include the information in support of the claim of having the capacity to safely handle more than 10,000 tonnes of Group C ANBF (e.g. risk assessment, description of stowage facilities, safety and security procedures, emergency preparedness procedures, firefighting capabilities, personnel training, drills, etc.).

7.3 The application shall contain a request for TCMSS to review the submitted information and, based on the results of the review, confirm that the ability of the port to safely handle the specified quantity of Group C ANBF was demonstrated to the satisfaction of Transport Canada.

7.4 The Manager, Port State Inspections and Cargoes verifies the completeness of the application.

7.5 Upon successful verification of the application, the Executive Director, Navigation Safety and Environmental Programs issues a letter to the port authority to confirm that the ability to safely handle the specified quantity of Group C ANBF was demonstrated to the satisfaction of Transport Canada.

7.6 The letter shall contain a reminder to the port authority of the responsibilities for the safety of persons and property in the port, the environmental protection of the port and the management of the marine infrastructure and services of the port in accordance with the requirements of section 20 of the Port Authorities Operations Regulations under the Canada Marine Act.

9 Date of application

9.1 This procedure becomes effective on 23/09/2019.

10 Date for review

10.1 This procedure will be reviewed twelve (12) months from the effective date and every five (5) years thereafter.
