2 Purpose

2.1 This procedure exists to provide guidance to Transport Canada Marine Safety (TCMS) employees engaged in monitoring the compliance of vessels enrolled in the Small Vessel Compliance Program (Non-Pleasure Craft) (SVCP).

3 Authority

3.1 This procedure falls under the overall administrative authority of the Director General, Marine Safety and the Marine Safety Executive (MSE) committee has approved this policy for general application.

4 Background

4.1 This procedure exists in support of the Small Vessel Compliance Program (Non-Pleasure Craft) (SVCP) Policy. The SVCP operates under the Canada Shipping Act, 2001 and the Small Vessel Regulations. Through the SVCP , Transport Canada Marine Safety supports and monitors the safety of small powered non-pleasure vessels.

5 Scope

5.1 This procedure applies to TCMS employees involved in the process of monitoring the compliance of vessels enrolled in the SVCP .

6 Responsibility

6.1 The Director, Domestic Vessel Regulatory Oversight is responsible for the development, approval and maintenance of this procedure.

6.2 The Manager – Flag State Inspection Standards (AMSAD) is the OPI for this procedure.

6.3 The Regional Directors, Marine Safety, are responsible for the implementation of this procedure.

7 Procedure

7.1 TCMS Regions are responsible for prioritizing vessel monitoring based on risk assessments of the vessels enrolled in the SVCP . Inspections of small non-pleasure vessels may also be scheduled in response to an accident or incident, or at random.

7.2 'Objective Evidence'. For the purpose of this procedure, 'Objective Evidence' that triggers a Detailed Inspection includes, but is not limited to:

  • Evidence that the vessel's operations are not being conducted safely.
  • An incident or accident that has just occurred on the vessel.
  • Inaccurate or expired certificates or documents.
  • Crewmembers display unfamiliarity with their assigned emergency duties or operational procedures.
  • Essential vessel operations relating to pollution prevention operations have not been conducted as required by the regulations.
  • Principal arrangements or essential equipment is absent or defective.
  • The vessel has excessive unsanitary conditions.
  • Any other evidence, including the receipt of a complaint, that leads a Marine Safety Inspector to believe that the vessel is not compliant with the requirements of the Canada Shipping Act, 2001 or its associated regulations.

7.3 When objective evidence warranting a Detailed Inspection is found, TCMS must engage in Compliance and Enforcement actions, as applicable and appropriate. The Policy on Compliance and Enforcement of the Canada Shipping Act, 2001 shall be used as a guideline for action.

7.4 Results of all inspections must be entered into the SVCP Database.

9 Definitions

9.1 "Authorized Representative (AR)" has the meaning ascribed to it in section 14(1) of the Canada Shipping Act, 2001.

9.2 "Non-pleasure vessel" refers to any vessel other than a pleasure craft.

9.3 The term "pleasure craft" is defined in section 2 of the Canada Shipping Act, 2001 .

10 Date of Application

10.1 This procedure comes into effect on June 2, 2011.

11 Date for Review

11.1 This procedure will be reviewed no later than twelve months (12) months following the date of approval and at a frequency of not less than three (3) years thereafter.
