Issue:
Transport Canada and TOMY International would like to advise consumers that retail packaging and point of purchase marketing material for certain The First Years Pathway booster seats are in conflict with the written product labelling and instruction booklet. The affected Pathway booster seats’ retail packaging and marketing point of purchase material state that the minimum weight for an occupant is 16.6 kg (30 lbs .), whereas the product labelling and instruction booklet indicate 18 kg (40 lbs ).
The Pathway booster’s written product labelling and instruction booklet correctly state that the minimum weight for the occupant is 18 kg (40 lbs .), as required under section 409.(1)(d) of the Canadian Motor Vehicle Restraint Systems and Booster Safety Regulations.
Company Action:
TOMY International will provide to retailers and all registered owners a notification and labelling for the retail packaging, as well as updated point of purchase marketing material, in order to correct the incorrectly listed weight.
Consumer Recourse:
Parents and caregivers can continue to use the Pathway booster safely. Caregivers should refer to the Pathway’s written product labelling and instructions booklet for the correct minimum occupant weight recommendation. The affected restraint systems should not be returned to the TOMY International or the retailer.
