EXEMPTION FROM SUBSECTION 625.85(1) Appendix A (28) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Canadian Air Operators from the requirements in paragraph 605.85(4) of the Canadian Aviation Regulations, subject to the conditions of this exemption.

This paragraph states (1) Pursuant to subsection 605.85(4) of the CARs, no maintenance release is require in respect of the tasks identified as elementary work in Appendix A (28) of this standard. Appendix A (28): Checking and adjusting air pressure in helicopter floats, and aircraft tires having an operating pressure below 100 psi, except on aircraft operated under CAR 704 and CAR 705.

The requirements of Section 605.85(4) and 625.85(1) Appendix A (28) are detailed in Appendix A to this exemption.

Purpose

The purpose of this exemption is to permit Canadian air operators not operating under  705 to include in their Elementary Work Training the checking of the aircraft tire air pressure with an operating pressure greater than 100 psi.

Application

This exemption applies to Canadian Operators, except Air Operators operating under CAR 705, who require tire pressures to be checked before intended flight on aircraft with tire pressure above 100 psi.

Conditions

  1. Operator will train the pilots with an initial and annual training to AME standards to check the tire pressures when necessary. This training will include all procedures.
  2. Training must be documented in the pilot’s training record and retained for two years.
  3. Pilots will check tire pressures only when there are no other practical options.
  4. Nothing in this exemption relieves the Air Operator from compliance with the provisions of any Canadian aviation documents that have been issued pursuant to the Aeronautics Act
  5. When directed by Transport Canada, the Air Operator shall make the training records available for inspection by Civil Aviation Safety Inspectors, in accordance with the Aeronautics Act.

Validity

This exemption remains in effect until the earliest of the following:

  1. December 31th, 2011; 23:59 EDT
  2. the date on which any one of the conditions set out in this exemption is breached;
  3. the date on which this exemption is cancelled in writing by the Minister, where he is of the opinion that it is no longer in the public interest or is likely to affect aviation safety.

Appendix A

Maintenance Release and Elementary Work

605.85 (4) No maintenance release is required in respect of tasks identified as elementary work in the Aircraft Equipment and Maintenance Standards.

625.85 (1) Pursuent to subsection 605.85(4) of the CARs, no maintenance release is required in respect of the tasks identified as elementary work in Appendix A of this standard.
