EXEMPTION FROM SUBPARAGRAPH 704.115 (2) (a) (ii) AND PARAGRAPH 704.108 (1)d) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after having taken into account that the exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt air operator, Skyservice Aviation Inc., 9785 Ryan Avenue, Dorval, Quebec, H9P 1A2, from the requirements set out in Subparagraph 704.115 (2) (a) (ii) of the Canadian Aviation Regulations (CARs), under the conditions specified in Subsection 724.115 (28) of the Commercial Air Services Standards (CASS). This subsection requires that the Air Operator's ground and Flight Training Program shall include for flight crew members a line indoctrination training. This paragraph 704.108 (1)d) requires that the air operator flight crew member has fulfilled the requirements of the air operator's ground training program and, except where undergoing line indoctrination training, the air operator's flight training program.

Purpose

The purpose of this exemption is to permit `Skyservice Aviation Inc.', to utilize the below-mentioned Flight Crew members without a line indoctrination training, considering their current experience with Aircraft type WW24 (Westwind 1124), under Part 604 of the Canadian Aviation Regulations.

Application

This exemption only applies to the following Fight Crew members for the Aircraft type WW24 (Westwind 1124), when operated by Skyservice Inc. under Air Operator Certificate number 9638:

Conditions

This present exemption is granted subject to the following conditions:

  1. All pertinent training pursuant to the Skyservice Training Manual shall be completed.
  2. The record of flying time accomplished under Parts 604 and 704 shall be documented in the above-named pilots' files.
  3. The training on the above Aircraft types shall be documented in the Pilots' training files.

Validity

This exemption is in effect until the earliest of the following:

a) April 1st, 2006 at 23:59 EST

b) The date on which one of the conditions set out in the exemption is breached;

c) The date on which this exemption is cancelled in writing, by the Minister, where he is of the opinion that it is no longer in the public interest, or that it is likely to affect aviation safety.
