Exemption from subsection 700.16(2) of the Canadian Aviation Regulations (CARs)

Pursuant to subsection 5.9(2) of the Aeronautics Act and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Aviation Starlink Inc., 9025 Ryan Avenue, Dorval, Québec  H9P 1A2, operating under subpart 5 of Part VII of the Canadian Aviation Regulations (CARs), from the application of subsection 700.16(2), subject to the following conditions. This subsection requires that a flight crew member receive at least 24 consecutive hours free from flight duty following 3 consecutive flight duty time assignments that exceed 12 consecutive hours unless the flight crew member has received at least 24 consecutive hours free from flight duty between each flight duty time assignment.

PURPOSE

The purpose of this exemption is to permit the air operator, Aviation Starlink Inc., to carry out 5 consecutive flight duty time assignments that exceed 12 consecutive hours, by having Mr. Stephen Douglas Wade act as an instructor-pilot and line indoctrination training facilitator, and ensuring that he receives two consecutive periods free from flight duty of at least 24 hours each week, i.e. Saturday and Sunday, in order to begin the operation of the aircraft EMB-120 and train the first flight crews.

APPLICATION

This exemption applies only to Mr. Stephen Douglas Wade, licence number AA130246, acting as a pilot (instructor and line indoctrination training facilitator) from Monday to Friday.

CONDITIONS

This exemption is subject to the following conditions:

  1. The company must offer a rest period of at least 8 continuous hours in suitable accommodation for each 24-hour period;
  2. The waiting time in Toronto during the flight duty time cannot be counted as a rest period;
  3. The air operator grants Mr. Stephen Douglas Wade two consecutive periods of at least 24 consecutive hours per week, i.e. Saturday and Sunday;
  4. All other conditions set out in the other subsections of section 700.16, including the 15-minute period following the flight, the duty time limits, the rest periods, the flight time limits, unforeseen operational circumstances, the period free from service, and others, must be met as outlined in the CARs.

VALIDITY

This exemption is in effect until the earliest of the following:

  1. 23:59 EST, April 1, 2005;
  2. the date on which any of the conditions set out in this exemption is breached; or
  3. the date on which this exemption is cancelled, in writing, by the Minister, where he is of the opinion it is no longer in the public interest or is likely to affect aviation safety.
