EXEMPTION 295-2003 - Nav Canada

EXEMPTION FROM PARAGRAPH 801.01(2)(a) AND PARAGRAPH 801.08(b) OF THE CANADIAN AVIATION REGULATIONS AND SUBPARAGRAPH 2.1(b)(ii), CLAUSE 2.1(d)(i)(B), SUBPARAGRAPHS 2.1(d)(ii) AND 2.1(e)(ii), CONDITIONS 2 OF TABLE 2.3, SUBPARAGRAPHS 2.4(b)(i) AND 5.1(b)(ii), CLAUSE 6.2.1(c)(ii)(A), SUBPARAGRAPH 6.2.2(c)(v), PARAGRAPHS 6.3.1(d), 6.3.2(c) AND 6.3.3(e) OF CHAPTER 3 OF STANDARD 821- CANADIAN DOMESTIC AIR TRAFFIC CONTROL SEPARATION STANDARDS

Pursuant to subsection 5.9 (2) of the Aeronautics Act, and after having taken into account that the exemption is both in the public interest and is not likely to affect aviation safety, I hereby exempt NAV CANADA, 77 Metcalfe Street, Ottawa, Ontario K1P 5L6 and all air traffic controllers working for hire or reward for NAV CANADA from the requirements of subparagraph 2.1 (b) (ii), clause 2.1 (d) (i) (B), subparagraphs 2.1 (d) (ii) and 2.1 (e) (ii), conditions 2 of Table 2.3, subparagraphs 2.4 (b) (i) and 5.1 (b) (ii), clause 6.2.1 (c) (ii) (A), subparagraph 6.2.2 (c) (v), paragraphs 6.3.1 (d), 6.3.2 (c) and 6.3.3 (e) of Chapter 3 of Standard 821 - Canadian Domestic Air Traffic Control Separation Standards, made pursuant to paragraph 801.01(2)(a) and paragraph 801.08(b) of the Canadian Aviation Regulations (CARs), subject to the following conditions.

The requirements of subparagraph 2.1 (b) (ii), clause 2.1 (d) (i) (B), subparagraphs 2.1 (d) (ii) and 2.1 (e) (ii), conditions 2 of Table 2.3, subparagraphs 2.4 (b) (i) and 5.1 (b) (ii), clause 6.2.1 (c) (ii) (A), subparagraph 6.2.2 (c) (v), paragraphs 6.3.1 (d), 6.3.2 (c) and 6.3.3 (e) of Chapter 3 of Standard 821 - Canadian Domestic Air Traffic Control Separation Standards, are detailed in Appendix A to this exemption.

Purpose

The purpose of this exemption is to allow NAV CANADA air traffic controllers to use quadrangle situation displays, when providing terminal control services, for the purpose of applying the 3 mile radar separation in accordance with Chapter 3 of Standard 821 - Canadian Domestic Air Traffic Control Separation Standards.

Application

This exemption applies to NAV CANADA and all NAV CANADA air traffic controllers when:

  • the quadrangle situation displays are being used in the control of aircraft and terminal control services are being provided; and
     

  • the air traffic controllers have received training and have been deemed competent by NAV CANADA with the application of the quadrangle situation displays.

Conditions

This exemption is granted subject to the following conditions:

  1. When using quadrangle situation displays and when the 3 mile or 1.5 mile radar separation standard is used, a maximum scale of 120 miles left to right of the screen shall be displayed on the radar display;
     
  2. When using quadrangle situation displays and when the 1 mile or target resolution radar separation standard is used, a maximum scale of 80 miles left to right of the screen shall be displayed on the radar display;
     
  3. When using quadrangle situation displays and when the parallel, divergent, intersecting or non-intersecting runway radar separation standard is used, a maximum scale of 120 miles left to right of the screen shall be displayed on the radar display;
     
  4. When applying the criteria as specified in conditions (a), (b) and (c) using the quadrangle situation displays, NAV CANADA air traffic controllers shall continue complying with all relevant sections of the Canadian Domestic Air Traffic Control Separation Standards;
     
  5. NAV CANADA ar traffic controllers shall not apply the criteria as specified in conditions (a), (b) and (c) using the quadrangle situation displays unless they have received familiarization training and have been deemed competent by NAV CANADA with the application of the quadrangle situation displays.

Validity

This exemption is in effect until the earliest of the following:

  1. August 1st, 2005 at 23:59 UTC;
     
  2. The date on which an amendment to the appropriate provisions of the Canadian Aviation Regulations or related standards comes into effect;
     
  3. The date on which any one of the conditions set out in this exemption is breached; or
     
  4. The date on which this exemption is cancelled, in writing, by the Minister of Transport, where he is of the opinion that it is no longer in the public interest or that it is likely to affect aviation safety.
