EXEMPTION FROM SECTION 525.01 OF THE CANADIAN AVIATION REGULATIONS, PARAGRAPH 525.811(g) AND SUBPARAGRAPHS 525.812(b)(1)(i) and (ii) OF THE AIRWORTHINESS MANUAL

Pursuant to paragraph 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Bombardier Aerospace, 123 Garratt Blvd., Downsview, Ontario from the requirements of paragraph 525.811(g) and subparagraphs 525.812(b)(1)(i) and (ii) of the Airworthiness Manual made pursuant to section 525.01 of the Canadian Aviation Regulations.

Paragraph 525.811(g) and subparagraphs 525.812(b)(1)(i) and (ii) of the Airworthiness Manual establish the emergency exit sign marking and dimensional requirements for the certification of transport category aeroplanes.

The details of the above provisions are provided in Appendix A to this exemption.

PURPOSE

This exemption will permit Bombardier Aerospace to install emergency exit signs with non-English lettering and/or markings that do not comply with the Airworthiness Manual requirements on any new DHC-8 Series 100, 200, 300 and 400 aeroplane for the purpose of facilitating delivery of the affected aeroplane to a foreign customer.

APPLICATION

This exemption applies to Bombardier Aerospace only for the installation of emergency exit signs with non-English lettering and/or markings that do not comply with the Airworthiness Manual requirements on any new DHC-8 Series 100, 200, 300 and 400 aeroplane.

CONDITIONS

This exemption is subject to the following conditions:

  1. The exemption from Airworthiness Manual (AWM) Paragraph 525.811(g) and 525.812(b)(1)(i) and (ii) shall be limited to exit sign language, letter and character height and height to stroke-width ratios for new Bombardier DHC-8 Series 100, 200, 300 and 400 aeroplanes only, where:
  1. the foreign customer of the affected aeroplane has requested illuminated exit signs to meet their airworthiness requirements and English language characters are either not to be included or cannot be practically incorporated into the design of the exit sign in compliance with AWM 525.811(g) and 525.812(b)(1)(i) and (ii);
  2. the aeroplane will be exported directly following the completion of the manufacturing and customer acceptance activities;
  3. a written statement will be obtained by Bombardier from the civil aviation authority of the importing state indicating acceptance of the affected illuminated exit signs markings and characters;
  4. the aeroplane is to be operated by Bombardier while registered in Canada and having a Canadian issued Certificate of Airworthiness (C of A); and
  5. the aeroplane operation is to be limited to activities regarding customer acceptance, customer delivery and associated ferry flights.
  1. Modifications for which this exemption is applicable shall include the following:
  1. Bombardier shall include reference to the Transport Canada Exemption in the “Applicable Requirements” section on the Statement of Compliance for the modification.
  2. Bombardier shall include reference to the importing authority’s acceptance of the illuminated exit sign markings and characters in the “Proof of Compliance” section on the Statement of Compliance for the modification.

 VALIDITY

This exemption is in effect until:

  1. the date on which any of the conditions set out in this exemption is breached;
  2. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that the exemption is no longer in the public interest, or that it is likely to affect aviation safety.

Transport Category Aeroplanes

525.01 The standards of airworthiness for the issuance of a type certificate in respect of a transport category aeroplane, or for a change to such a type certificate, are those specified in Chapter 525 of the Airworthiness Manual.

525.811 Emergency Exit Marking

  1. The location of each passenger emergency exit must be indicated by a sign visible to occupants approaching along the main passenger aisle (or aisles). There must be:
  1. A passenger emergency exit locator sign above the aisle (or aisles) near each passenger emergency exit, or at another overhead location if it is more practical because of low headroom, except that one sign may serve more than one exit if each exit can be seen readily from the sign;
  2. A passenger emergency exit marking sign next to each passenger emergency exit, except that one sign may serve two such exits if they both can be seen readily from the sign; and
  3. A sign on each bulkhead or divider that prevents fore and aft vision along the passenger cabin to indicate emergency exits beyond and obscured by the bulkhead or divider, except that if this is not possible the sign may be placed at another appropriate location.

(g) Each sign required by paragraph (d) of this section may use the word "exit" in its legend in the place of the term "emergency exit".

525.812 Emergency Lighting

  1. (b) Emergency exit signs:
  1. For aeroplanes that have a passenger seating configuration, excluding pilot seats, of 10 seats or more must meet the following requirements:
  1. Each passenger emergency exit locator sign required by 525.811(d)(1) and each passenger emergency exit marking sign required by 525.811(d)(2) must have red letters at least 1½ inches high on an illuminated white background, and must have an area of at least 21 square inches excluding the letters. The lighted background-to-letter contrast must be at least 10:1. The letter height to stroke-width ratio may not be more than 7:1 nor less than 6:1. These signs must be internally electrically illuminated with a background brightness of at least 25 foot-lamberts and a high-to-low background contrast no greater than 3:1.
  2. Each passenger emergency exit sign required by 525.811(d)(3) must have red letters at least 1½ inches high on a white background having an area of at least 21 square inches excluding the letters. These signs must be internally electrically illuminated or self-illuminated by other than electrical means and must have an initial brightness of at least 400 microlamberts. The colours may be reversed in the case of a sign that is self-illuminated by other than electrical means.
