Regulatory Stock Review Plan

Transport Canada is committed to ensuring that the regulations that it administers are effective and efficient. This is achieved through both its Forward Regulatory Plan as well as periodic stock review of Transport Canada’s regulations. Periodic stock reviews help to ensure that regulations remain relevant and up to date. Results of a review should inform future regulatory development, thereby continuing the regulatory life cycle.

Motor Carrier Safety Fitness Certificate Regulations

Rationale and approach for the review

The Motor Carrier Safety Fitness Certificate Regulations have not been updated since 2006; therefore, they will be reviewed to assess their effectiveness and ensure they remain relevant and aligned with evolving legislation, policy objectives and priorities. The Canadian Council of Motor Transport administrators (CCMTA) is the curator of Standards 7, 14 and 15 under the National Safety Code. The safety fitness regulations refer to these standards. These three standards are currently under review at CCMTA. The review of Motor Carrier Safety Fitness Certificate Regulations should begin once the CCMTA reviews are completed.

The Shipping Casualties Reporting Regulations have not been updated since 2007. They are being reviewed to assess alignment with current legislation and reporting requirements, and to remove any inconsistencies or overlap with other regulatory frameworks. Transport Canada is actively engaging regional stakeholders for input on how these regulations should be updated.

The By-laws Nos. 6 and 8 of VIA Rail Canada Inc. have not been updated since 1979; therefore, Transport Canada assessed their effectiveness to ensure they remain relevant and aligned with evolving legislation, policy objectives and priorities.

The regulations were reviewed in 2023-2024.

Stakeholder feedback

VIA Rail Canada Inc.’s (VIA Rail) Chairperson sent the Minister of Transport a letter on April 30, 2020, informing the Minister that the Crown corporation has repealed its By-laws Nos. 6 and 8, citing that these By-laws contain rules and requirements relating to passenger safety that can be found in other legislation and regulations.

VIA Rail has recently indicated that they have no concerns with Transport Canada proceeding with the repeal of the regulations By-laws Nos. 6 and 8 of VIA Rail Canada Inc. (SOR/79-817). Repealing this regulation would align Transport Canada with VIA Rail, avoiding a duplication of passenger safety rules and requirements.

Outcomes

Transport Canada reviewed and confirmed that the regulations will be repealed.
