Whereas, pursuant to subsection 30(1) of the Transportation of Dangerous Goods Act, 1992Emergency Response Task Force , a copy of the proposed Regulations Amending the Transportation of Dangerous Goods Regulations, substantially in the form set out in the annexed Regulations, was published in the Canada Gazette, Part I, on August 16, 2003 and a reasonable opportunity was afforded to interested persons to make representations to the Minister of Transport with respect to the proposed Regulations;

 

 

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 27 of the Transportation of Dangerous Goods Act, 1992Emergency Response Task Force , hereby makes the annexed Regulations Amending the Transportation of Dangerous Goods Regulations.

REGULATIONS AMENDING THE TRANSPORTATION OF DANGEROUS GOODS REGULATIONS

AMENDMENTS

1. The portion of item 22 of the table to paragraph 1.3(2)(f) of the Transportation of Dangerous Goods Regulations1 in Column 2 is replaced by the following:

ICAO Technical Instructions "Technical Instructions for the Safe Transport of Dangerous Goods by Air", 2003-2004 Edition, published by the International Civil Aviation Organization (ICAO)

2. The definition "ICAO Technical Instructions" in section 1.4 of the Regulations is replaced by the following:

ICAO Technical Instructions
means the "Technical Instructions for the Safe Transport of Dangerous Goods by Air", 2003-2004 Edition, published by the International Civil Aviation Organization (ICAO). (Instructions techniques de l'OACI)
 

3. Paragraph 12.4(a) of the French version of the Regulations is replaced by the following:

(a) la personne se conforme aux Instructions techniques de l'OACI, sauf à la 4e Partie, Instructions d'emballage, et aux articles 1.1 à 1.3 du chapitre 1er, Généralités, aux articles 2.1 à 2.4.1 et 2.4.3 à 2.5 du chapitre 2, Marquage des colis, du chapitre 3, Étiquetage, et du chapitre 4, Documents, de la 5e Partie, Responsabilités de l'expéditeur;

4. Subparagraph 12.7(1)(a)(ii) of the Regulations is replaced by the following:

(ii) the ICAO Technical Instructions, other than that part of paragraph 1.2.7.1, Generic or "not otherwise specified" (n.o.s.) names, of Chapter 1, General, of Part 3, Dangerous Goods List and Limited Quantities Exceptions, that requires the technical name for dangerous goods; and

5. Subparagraph 12.9(11)(a)(i) of the Regulations is replaced by the following:

(i) the third sentence of Special Provision A123 of Chapter 3, Special Provisions, of Part 3, Dangerous Goods List and Limited Quantities Exceptions, of the ICAO Technical Instructions, and

COMING INTO FORCE

6. These Regulations come into force on the day on which they are registered.
